Show clent evidence and ordered a new trial. - Vance will attack the testimony of Mary Vanco Ward, his slsterln-law, and Lena Vance, bis daughtr. Mrs. Wurd and Miss Vance were two of the chief and necessary witnesses for the state at the first trial, and Vance hopes to upset their testimony. Vance will try to show that Mrs. Ward's rep- ( utfttlon for truth and veracity is bad. j presenting affidavits from the bishon of Mrs. Ward's ward that he would not believe her on oath, and thai her testimony has been entirely refuted since his first trial, and that his daughter was Induced to testify false-ly false-ly against him under threats of being sent to jail If nhe tesTUIed otherwise. Vance is alleged to have kicked Mary Vance, his sickly wife, November Novem-ber 2fi. 19'J7, and administered to ber bichloride of mercury in a glass of water, November 2S. Thomas Vance's second trial for alleged wife murder was begun In District Judg lewis's court Monday afternoon. The case was set foi lu o'clock in the morning but at that hour S A. Maginnls of counsel for Vance asked for a continuance continu-ance until 2 o'clock In the afternoon to give A J. Weber, recently retained to assist in Vance's defense, a charge to confer with Vance's counsel. Tho request was cranted. The first day passed without a sin gle juror being seated.
