Show FIST FIGHT COST fl!M A FNE Frwin lowing, charged with assault aud battery on Martin Smith, was given a hearing in police court this morning and fined $10 or ten days. The alleged assault took place on October Oc-tober IS, at Five Points, and was the I outccme of the efforts of Smith to collect a note for $20. which be claimed was due through the sale of a cow. Smith stated on the stand that Kwlng had met him ori the stree; at Five Points and, after some words, had struck blrti, koocklng him down. After he was kneekc-d down. Kwlng kicked at him and he, m defens-e, caught the man's foot, pulling hlin to the ground. Smith said that when lowing fell he get up and went Into a saloon to wipe the blood from his face, where Kwlng had struck him. When he came out of the Miloon. Kw-Ir.g Kw-Ir.g was waiting for him and again hit him with his fist and again he fell to tho ground. Kwlng stated that the asimlf was provoked by Smith's jierslstnt dunning dun-ning ami by the fact that Smith abused hi father an.l told nl) of the neighbors about the note which he held on the sale of the cow. He also claimed thai Smith had not passively submitted to the Hsault but had struck tit him with his flt several times. |
