The new est ray law makes it obligatory on the pound keeper, that is the Constable of the precinct, pre-cinct, to receive all animals taken up for damages. The poundkeeper is to make complaint as a public officer, alleging that the person naming him who has turned over the animals has been damaged damag-ed in the amount he has assessed, fn cases where the marks and brands 011 est ray animals cannot be found in the brand sheets, and as a consequence no one knows to whom the' belong, the Justice and Constable are under bonds to perform per-form their duties in relation to estrays and cannot be required to give additional bouds as security for costs in suits to cover damage done by estrays. The Justice is required, however, by law to entertain enter-tain any and all charges. The system of the new law places all estrays under three classes as follows: fol-lows: 1. Unbranded animals over eighteen months old and hogs running at large. 2. Animals taken in general "round-ups" or drives; and these include branded animals when owners are unknown. un-known. 3. Branded animals doing do-ing damage, the owner of which may be learned from the Territory brand sheets or otherwise. Separate Sep-arate provisions are made for each of these classes. |
