CCMMINGS AND t C. I). Cummings his wife, on the 24th day of April, 1891, executed and delivered to the Salt Lake Valley Loan and Trust Company their certain cer-tain promissory note for the sum of 2750. payable pay-able on the 24th day of October, 1891, with interest thereon at the rate of 8 per cent, per annum from date until maturity, payable quarter-annually, according ac-cording to the tenor and effect of two interest coupons each for thesum of $55. attached to said principal note, and with interest after maturity upon all sums remaining unpaid at the rate of 12 per cent, per annum until fully paid; and. Whereas, to secure the payment of said note according ac-cording to its true tenor and' effect, the said Mar-low Mar-low L. Cummings and C. D. Cummings, his wife, on said April 24th, 1891, executed and delivered to O. J. Salisbury and Simon Bamberger, Trustees, of Salt Lake City and County, Ctah Territory, a certain deed whereby they conveyed to the said O. J. Salisbury and Simon Bamberger in trust, the following described premises situate in Salt Lake County, Ctah Territory, to wit: "All of Lota Nineteen (1 and Twenty (20 in Bloc k One (1) of Rice & Gelder'e First Addition. Said Addition being a subdivision of Lots Fourteen Four-teen U) and Fifteen (15) of Block Thirteen (IS), Five Acre Plat "A" Big Field Survey," which said deed was duly filed for record in the office of the County Recorder of Salt Lake Countv. Utah Territory, on the said 24th day of April, 1891-and 1891-and recorded in book "3A" of the mortgage records of said office, on page 434; and, Whereas, said deed provides, among other things, that should default be made in the pay ment of said note according to its true tenor and effect, said trustees, or either of them, or in case of their refusal to act or disability in any wise, the then acting Sheriff of said County, at the re, quest of the legal holder of said note, may proceed pro-ceed to sell the property in said deed and herein-lx'fore herein-lx'fore described. at public vendue to the highest bidder, at the front door of the Court House in the County of Salt Lake, Territory of Utah, for cash, first giving thirty days' public notice of the time, terms ana place of sale, and description of the property to be sold, by advertisement in some newspaper printed and published in Salt Lake County, Utah ; and Whereas, Said makers of said note have utterly failed and refnsed to pay the same or any portion thereof, aud the same is now wholly due and unpaid: un-paid: and Whereas, said trustees first named herein are nnable to act, and have refused to act, now, therefore, there-fore, pursuant to the power in me vested by said trust deed, and at the request of the First National Na-tional Bank of Deadwood, of the City of Deadwood, State of South Dakota, the present and legal holder of said not I, A. J. Burt, sheriff of Salt Lake County, Utah Territory, will, at the front door of the Court House of Salt Lake County, in the City of Salt Lake, L'tah Territory, Ter-ritory, on the 19th day of December, 1891, between the hours of 12 o'clock m. and 2 o'clock p. m. of said day, sell at public vendue for cash, the premises hereinbefore and in said deed described, de-scribed, to satisfy said note and interest, and the costs of executing this trust, including ten per cent attorneys fees as stipulated for in aaid trust deed.
