INLAND PRODUCTION COMPANY FOR FAILURE TO COMPLY WITH UNDERGROUND INJECTION CONTROL REGULATIONS PURPOSE OF PUBLIC PUB-LIC NOTICE The purpose of this notice is to solicit written comments on a Proposed Administrative Order that Region VIII of the United States Environmental Protection Agency (EPA) issued against Inland Resource Inc., and Inland Production Company (jointly the Respondents), 473 17th Street, Suite 1500, Denver, Colorado. EPA issued the Respondents the Proposed Administrative Order, Docket No. SDWA-8-99-57 on September 22, 1999. The Proposed Administrative Order lists alleged violations viola-tions and proposes required remedies and monetary penalties for the alleged violations. The Proposed Order is issued under the Underground Injection Control (UIC) provisions of the Safe Drinking Water Act (SDWA) and the Act's implementing regulations. These regulations regula-tions govern the injection of fluids that may endanger endan-ger an underground source of drinking water (USDW). The EPA desires to receive written comments from any interested party having knowledge of the alleged violations or that can provide any information informa-tion useful to ensure that the remedies proposed are appropriate. If no comments are received regarding this Order, it will be issued as a final Administrative Order and will become effective thirty (30) days following the date issued. EPA will review any comments received on the Proposed Administrative Order, and will thereafter determine deter-mine whether to modify or withdraw the Proposed Order or whether to issue a final Administrative Order and whether to asses the proposed penalty- BACKGROUND Part C of the Safe Drinking Act (SDWA) requires the EPA to regulate regu-late underground injection injec-tion of fluid through wells to assure that underground sources of drinking water (USDW) are not endangered. Section 1421 of the SDWA requires EPA to administer UIC programs in States or on Indian Lands which do not have approved State or Tribal UIC programs. Regulation of the UIC Program has not been delegated on the Ute Indian Lands, therefore EPA administers the program pro-gram in accordance with Title 40 of the Code of. Federal Regulations (40 CFR). Parts 124, 144, 146. 147 and 148. The thirty (30) enhance recovery (ER) injection wells which are the subject sub-ject of this Proposed Administrative Order are operated by the Respondent The wells are located on Tribal Lands on the Uintah & Ouray Indian Reservation in Utah, and are located in the Monument Buites Field, Gilsonite, Jonah, Boundary, Pleasant Valley, Castle Draw, Lone Tree and Beluga Units, and the East Red Wash Field, Coyote Basin Unit in Duchesne County, Utah. (a) & (b) of EPA UIC Individual Permit UT8253-04457 for failure fail-ure to comply with the injection wells operating conditions, by injecting over the maximum authorized autho-rized injection pressure; and Permit Condition Part L and Part IL Section C 1. (a) & (b) of EPA UIC Permit UT2702-04299 UT2702-04299 for failure to comply com-ply with well completion requirements prior to commencing injection. The Proposed Administrative Order assesses an administrative administra-tive civil penalty in the amount, of $128,000.00. The Proposed Administrative Order also orders the Respondents to perform such testing and submit such information necessary neces-sary to ensure that the operation of the ER injections injec-tions wells listed above have not initiated new fractures or propagated existing fractures in the zone confining the injection injec-tion formation, including but not limited to the well monitoring records for each of the wells injecting inject-ing over their authorized maximum injection pressure. pres-sure. The Proposed Administrative Order further fur-ther directs the Respondents to submit to EPA for the Federal 11-21 11-21 (UT2702-04299) ER well the Well Rework Record and well conversion conver-sion records, documentation documenta-tion of a successfully completed mechanical integrity test, documenta--tion of date the well commenced com-menced injection, and well monitoring records for any injection prior to January 1, 1997. An SEOP is a flexible plan in which students make a career choice then take classes based on those objectives. Most students developed their plans in the ninth grade and then designed a four-year plan to help them work toward achieving that goal and to be prepared pre-pared for the next step after high school. If a student wants to change his or her career choice, it can be modified by talking with his or her counselor. Seniors will have an SEOP meeting meet-ing with their counselors and parents par-ents sometime during the First Trimester. This meeting is to check graduation credits, to be sure that the counselor and parents are aware of the student's plans after graduation, gradua-tion, and to discuss post-high school plans. Seniors have been asked to arrange an appointment time with their counselor for this meeting.
