Show SHE STILL DECLINES I Elizabeth Ann Starkey Again Appears Before the Grand Jury i She Refuses to Answer the Questions I Propounded and is Committed I for Contempt I Other Business Before the District Court ToDay In the Third District Court today in the case of Salt Lake Coun yvs D Rock Co1ts liolt a demurrer to complaint heretofore argued and submitted was entered and sustained Thirty days leave to amend was given In the case of Davis vs Lamb the d < c murrer was overruled and judgment given as prayed in complaint The case of Wescott vs Eccles was set aide and dismissed upon motion of Mi McBride In the case oftheD R G W Ry Cit C-it aI vs The D R G Ry Co et al demurrer to the complaint in the intre vent on wa allowed Tm muxn JURY Came into court and reported that tin case of the United States against Charles Ti White charged with polygamy and unlawful cohabitation is under investigation ation before the duly impanneled Grand Jury The testimony tending to show that some seven years ago the defendant White married and took to wife one Margaret Mar-garet Hamilton still living and that during dur-ing the past three years White has been living and cohabiting with his wife and one Elizabeth Ann Starkey in Salt Luke county Elizabeth Starkey was today ailed and sworn by the Grand Jury and asked the following questions QAre you married to C L White Qllave you at anytime within three year last past at tie County of Salt Lake in the Territory of Utah gone through any marriage ceremony with Chares L White QHao you during the last two years at t said county lived with C L White as I his wife QIlave you at any time within the I past two years sustained the relation of wife to Charles L White But to answer said questions or either of them the said witness Elizabeth Ann tarkey declined and refused so to answer an-swer Wherefore the Grand Jury re icctfnlly request the Honorable Court to advise and instruct the witness Miss Starkey whom they produced before Judge Zane to know whether or not the questions aforesaid were proper questions to be propounded to her and whether he is in duty bound to answer them The papers sent to Judge Zane were signed by Monis R Evans Judge Zane proceeded to ask some very j reasonable questions which Mrs Starkey absolutely refused to answer She was I I kindly counseled by the Court but to no avail She said no ono had advised her I or used influence to keep her quiet but sho had nothing to say Mrs Starkev I was committed again for contempt |
