Show I CHARGED WITH LIBEL 1 1 Thc Salt Lake Herald to Answer I for One of Its Truthful I Iteinjj On the 29th of June Mr Dan Simper residing at South Cottonwood and a cattleman I cat-tleman by occupation came to Salt Lake City for the purpose of disposing of i wool clip to Mr Pickard The latter gentleman gen-tleman expressed a desire to see a colt owned by Mr Simper which was down on the race track and the colt was brought up for Mr Pickards inspection After this Mr Simper requested Mr Neff the trainer of the colt to return to the track and Mr Simper then started for the Coop In crossing First South street he saw Mr Neff coming back walking by the side of the colt with the wagon wheel locked Mr Simper rode up and asked what was the matter Neff said the wheel was locked and he was going to Malquists shop to have it fixed Both men then proceeded to the blacksmith shou and finding that the wagon could not be fixed that night Mr Simper proposed to take the colt down to the track with his mare He led the colt up to the mare when it became unmanageable unman-ageable and had to be led away Mr Simper then delivered the colt to Mr Neff who led it behind a wagon to the track As Mr Simper was returning to his mare he was arrested by Officer Salmon Sal-mon for indecently exposing his horse and was bound over at the police court in the sum of 1 to appear the next day He left 585 Officer Bateman becoming security for the remaining 415 Next day he appeared for trial and was told that the case was settled although the case had never been called and the docket dock-et showed no record to that effect The Salt Lake herald of the 4th of July in its Police Court report contained the following item i Dan Simper whose education had evidently evi-dently been partly attained by reading the Tribune was fined 515 for indecent exposure The case was heard on its merits on Saturday last when Mr Simper was I acquitted although Salmon and three others testified against him I The Herald of yesterday apologized in I the following strain Dan Simper who was charged with being I drunk and indecently exposing a horse on the street was acquitted In justice to the gentleman we will say that our statement of a few days ago in reference to him was not true Through some misunderstanding at the Court the case did not come up for trial until yesterday although the records showed a charge against him of 5 The apology of the truthful Herald for printing such a grave amI indecent charge against the character of such charcter a gentleman gentle-man as Mr Simper is not entirely satisfactory satis-factory to the accused and today proceedings were commenced in u civil libel suit against the Herald charging defamation of character etc the damages being placed at several thousand dollars As there is no official I charge on which the Herald could possible have based its article it is hard to see how the truthful sheet can wriggle out of the very small hole in which the complainant seems to have cornered it I I |
