Show THAT LIBEL SUIT I Information for the Benefit of Solicitous So-licitous ITIoriiiuff Contemporaries Contempo-raries A certain morning contemporary announced an-nounced today that the DEMOCRAT company II com-pany had a libel suit on its hands Palmer Rey of San Francisco having I brought an action to recover 20000 damages We regret to state that this I I was all a morning contemporary lie and that no such suit has been commenced I The morning contemporary has again allowed al-lowed it inclination to prevaricate to get the better of its judgment Palmer I Rey notified the DEMOCRAT company that they would commence proceedings last Wednesday but as usual with that firm I they failed to fulfil their promises In view of the kindly interest manifested mani-fested in the affairs of the DEMOCRAT by both of our morning contemporaries we I deem it would not b improper to state I the cause of Palmer Reys grievances j for the especial information four incs as neither of them seems to possess much I knowledge of the matter I In the first place the DEMOCRAT company com-pany has promptly remitted for every article of material furnished by Palmer Hey that was furnished according to agreement The printing press that was I ordered was by the terms of the contract con-tract to arrive at a certain time and to be in firstclass condition Portions of it did get here at the time agreed upon Other portions have been arriving at intervals ever sincealid some of theparts have not yet made their appearance Instead of being in first class condition some of timepieces time-pieces were completely worn out When it was found that the press would be entirely worthless until reconstructed the DEMOCRAT company very naturally refused re-fused to accept as it had been guaranteed guaran-teed to be in firstclass condition Palmer Rey then sent on a man from San Francisco who claimed be an expert After tinkering at the press bra week he succeeded in getting it in running order but before doing so found it necessary neces-sary to send the worn out portions to the machine shops and have new pieces manufactured Before completing his labors he was forced to admit the press was not in firstclass conditon as the firm had guaranteed it to be When the press was finally rebuilt and got in running order the DEMOCRAT company com-pany offered what they considered a fair i price for a piece of worn out machinery but the offer was declined and Palmer Rey propose to bring suit for the sum the company agreed to pay for a firstclass press The DEMOCRAT took occasion to state through its columns that Palmer Rey had violated their contract an assertion which it now reiterates and that firm considers itself damaged by this statement state-ment in the sum of 20000 Whatever may be said of Palmer Reys unscrupulous un-scrupulous dealings they certainly place a proper estimate on the influence of the DEMOCRAT We hope Messrs Palmer Rey have not reconsidered their determination to institute legal proceedings No newspaper newspa-per is fairly launched upon the sea of prosperity until it has passed through the throes of a libel suit and Messrs Palmer Reys proposed suit will afford more fun for the DEMOCRAT than anything elseiweji could wish for I |
