Show City To Sue Local Businesses IFoir Failure To Pay Licenses Utah High Court May Decide That Cities Can Tax Professionals Some 15 Roosevelt businessmen will be sued by the city in the near future for non-payment of 1948 and 1949 business licenses AH Roosevelt businessmen, except offices operated by professional pro-fessional men must, according to a city ordinance, pay a license fee based on their store's inventory which must be submitted Jan-uary Jan-uary 1 of each year. Summons for hearings in Justice Jus-tice of the Peace court will be issued soon. Court proceedings will be held ten days after the service of summons. The judge's usual procedure in a case of this sort a civil case is to weigh the defendant's statements state-ments as to why he has not paid or why he thinks he should not pay, after which he will either dismiss the case or impose a judgment. A defendant is given 30 days after the judgment is imposed in which to file an appeal to a higher court. If no appeal has been filed, the judge will issuo a Writ of Execution which empowers em-powers the sheriff to enter a business house and take merchandise mer-chandise equal to the value of the judgment and sell it at public pub-lic auction. i i i According to George E. Stewart, Stew-art, city attorney, a case is before be-fore the state supreme court now which will decide whether or not professional men, i. e., doctors doc-tors lawyers, pharmacists, etc., can be licensed by a city. The Richfield, Utah, city council coun-cil recently passed an ordinance which would require professional men in that city to obtain city licenses.- The ordinance was appealed to the district court where it was held to be lawful. It was appealed ap-pealed because professional men, already licensed to practice by the state, felt that they shouldn't be licensed again. .. Since the district court upheld the city, the case has. been appealed ap-pealed to the state supreme court. -If the supreme court upholds the district court's decision, every city and town in Utah will be able to license professional men. |
