Show Notice Of Gas And Oil Mining Lease Sale UNDER SEALED BID. 2:00 P. M., OCTOBER 30, 1947 Sealed bids will be received at the Uintah and Ouray Agency, Fort Duchesne, Utah, until 2:00 o'clock P. M., October 30, 1947, for Oil and Gas leases on the following described Indian lands, located in the Uintah and Ouray Indian Reservation, in Uintah County, State of Utah, to wit: TRIBAL LAND Unit No. 1 NW SW, Section 12, Township 1 South, Range 2 West, Uintah Special Base and Meridian, containing contain-ing 40 acres more or less as surveyed. Each unit is offered for separate lease, for a cash bonus in addition to the stipulated royalties, and rental at $1.25 per acre per annum. The successful and responsible bidder for any lease will be required to pay in advance an annual rental of $1.25 per acre, his proportionate share of the cost of advertising, and a filing fee of $5,00 for each lease obtained and approved. A deposit of 20 per cent of the bonus bid and 20 per cent of the advance rental for the first year must accompany the bid and be in the form of a certified check or bank draft drawn on a solvent sol-vent bank, payable to the Treasurer of the United States. No individual, corporation, partnership, company or association associa-tion shall be permitted to hold under lease 'for oil andor gas mining purposes, Indian Tribal lands and restricted allotted Indian lands, in any one State in excess of 15,360 acres in the aggregate. Acreage leased by an officer or director of a corporation, company, or association, or by a stockholder holding 40 per cent or more of the stock of the corporation, company, or association, shall be charged against the corporation, company, or association, and vice versa. The acreage leased by a member of a partnership shall be charged against the partnership, and vice versa. The acreage of corporations, companies, or associations having common stockholders stock-holders owning a majority of the stock of each corporation, company, com-pany, or association, or having one or more common officers or directors, shall be charged against each other. The Sale will be held and the leases executed in accordance with the Act of March 3, 1909, (35'Stat. 781, 783), the Act of May 11, 1938 (52 Stat. 347), the regulations approved October 8, 1937 (25 C, F. R Part 189) as to allotted lands (see amendment to Section 189.13, May, 1947) and those approved May 31, 1938, (25 C F. R., Part 186) as to tribal lands, (see amendment to Section Sec-tion 186.9, May, 1947.) Lease Form 5-157 (June, 1939) will be used for tribal land lease contracts, and Lease Form 5-154h (September, 1943) for allotted land lease contracts. Failure of -the successful bidder to comply with the terms of the sale and the regulations, will render his deposit liable to forfeiture for-feiture in the discretion of the Commissioner of Indian Affairs. Leases filed after 20 days from date of mailing to lessee for execution execu-tion will be subject to revaluation of bonus, if permission is not granted for an extension of time. Sales will be cancelled and deposits de-posits forfeited at the expiration of the 20-day filing period, unless for good and sufficient reason, an extension of the filing period is granted. The right is reserved by the Commissioner of Indian Affairs to reject any or all bids and to disapprove any lease made on an accepted bid. Should any bid be rejected after deposit is made, through no fault of the bidder, all moneys deposited will be returned. re-turned. The term of the lease will be 10 years from the date of approval by the Commissioner of Indian Affairs and as much longer thereafter as the substances specified in the leases are produced pro-duced in paying quantities. The lessee must furnish a satisfactory surety bond as required by the regulations in the amount of $15,000. Bids received will be referred to the Ute Business Committee on the 40 acres of tribal lands, described as Unit 1, for the recommendation recom-mendation of that committee as to acceptance or rejection before such bids are referred to the Commissioner of Indian Affairs for further action. Bids received on allotted Indian lands will be referred re-ferred to the owners of such allotments before further action is taken by this office. Only as such bids are approved by such owners, under the regulations can a lease be drawn. All bids must be marked on the. outside of the envelope, "Bid on Oil and Gas Lease, Indian lands, not to be opened until 2:00 o'clock P. M., October 30, 1947." FORREST R.
