lake meridian thence west 2145 feet thence north 2145 feet thence east 2145 5 feet thence south 2145 feet to the place of beginning containing one 1 acre and five 5 rods together with one 1 acre of of first publication january 12 1939 date of last publication february 2 1939 25 2 5 COUNTY COUNTS OR ORDINANCE NO 53 an am ordinance flying fixing taxes on dogs providing for the collection thereof providing for the prevention of injuries to C cattle attle sheep and other animals by dogs doers and for the destruction of unlicensed and vicious dogs and those running at largo large and repealing sevier county ordinance no 82 32 the board of county commissioners of sevier county state of utah ordain as follows section 1 that sevier county ordinance no 32 be and it hereby is repealed section 3 2 every person owning or having charge of any dog or bitch over two months old within the limits of sevier county state of utah outside of the corporate limits of incorporated cities and towns shall pay for the use of said sevier county an annual tax of for every such dog and for every such bitch provided said payment shall only exempt the dog or bitch on which the tax is so paid from further taxation until january of the succeeding year section 3 every dog or bitch on which the tax is paid pursuant hereto shall wear upon its neck a metallic or other suitable collar with a metallic or other suitable plate or tag attached which said plate or tag shall be furnished by the sheriff of sevier county to the owner of said dog at the time the tax thereon is paid said tag or plate shall bear a number legibly stamped thereon which shall correspond with the number written on the receipt given for the payment of the tax as hereinafter provided section 4 it shall be the duty of the sheriff of sevier county at the time of payment of the tax provided above to deliver to the payer or to the owner of the dog upon which the tax is so paid the metallic plate or tag above mentioned and at the same time to deliver to said payer of said tax a receipt which shall bear the same number as the tag or plate which shall be delivered as aforesaid said receipts for the payment of the tax hereby imposed shall be made in duplicate and one delivered to the payer of the tax as aforesaid the duplicate receipts shall be retained by the sheriff of sevier county who shall safely keep all of said duplicate receipts for a period of one year after date of issuance and execution said receipts issued to the payers as aforesaid shall constitute certificates of registry of t the respective dogs bearing tags or plates with the coi responding corresponding numbers section 5 As to dogs and bitches born bom prior to january 2 of any particular year the annual dog tax hereby imposed shall be due on january 2 of each year unless that date falls on a holiday in which event the said tax shall be due the following day and said tax shall become delinquent and in default on february 18 of cach year As to dogs and bitches which are born bom after january 2 of any particular year the tax hereby imposed shall be due upon said dogs and biec bitches hes becoming two months of age and shall be delinquent and in default at the expiration of one month from and after said dogs attain an age of two months section 6 it shall be the duty of the se vier county bounty sheriff as soon as practicable after the day of brry b r of each and every year slay islay or cause to be slain all p within the county of sevier in ai which the tax hereby pro aed col c ol has not been paid or which fo 0 not carry a registry tag or plate as above required unless at el sc he i time of taking up s said aid dogs e tax hereby imposed is paid by the owners of the said dogs or the persons having the same in charge no notice need be given the owners or persons having the dogs in charge of nonpayment of the tax or of intention to destroy section 1 7 f it shall also be the duty of every person owning or having in charge any dog or bitch upon which the tax provided for in this chapter lias not been paid on or before the date of delinquency above stated to 0 slay or cause to be slain such nog dog or bitch this provision however shall not be construed or in 1 i to limit modify or in anywise affect the duty of the sevier county sheriff to slay said dog or cause the same to be slain as above provided section 8 every bitch running at large I 1 during her period of salacity may be slain by the sevier county sheriff his deputies or any precinct constable whether or not the tax herein provided has been paid section 9 the tax herein provided shall not apply to dogs or bitches which may follow or bo be led by any traveler into or through sevier county while with its owner or keeper or near tho the automobile wagon animals or effects of the same pro vided aided however that this exemption from tax shall not exempt said dogs and bitches of travelers from other provisions of this ordinance di nance section 10 it shall be unlawful for any per son to suffer or allow to run rim at large any dog or bitch owned or possessed by him known to be vicious or dangerous or to have bitten any person while passing peaceably along any street or alley in this county or to be afflicted with rabies section 11 any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall I 1 be punished by a fine of not more than or by imprisonment in in the county jail not more than 25 days or by both such fine and imprisonment section 12 it shall be the duty of every owner or person having any dog or bitch in charge whether registered or unregistered to keep the same safely and securely locked up chained or otherwise confined for a period from one hour after sunset of any day until one hour before sunrise of the fo following day any dog found running at large during the time when the same is required hereby to be locked up i chained or otherwise confined may be slain killed and destroyed by any person whomsoever provided further that any dog or bitch may be slain summarily at any time the same shall be found molesting interfering with bothering or endangering dan gering sheep cattle or other livestock turkeys chickens or domestic animals whether or not the tax on said dog or bitch has been paid section 13 it shall be unlawful for any person to deprive a registered dog of its registry tag or plate or to put a registry tag or plate on any dog not registered and on which the tax hereby provided has not been paid section LL 14 the chairman of the board of county commissioners may upon ica apprehension of danger from mad or rabid fogs issue a proclamation forbidding logs dogs of every description from running at lar large ge and after such proclamation shall have been issued and posted eight hours in any precinct of the county any dog or bitch found running at large therein except the same be securely ely muzzled may be slain by any person the proclamation cla shall be posted as to any precinct involved in a public and conspicuous place therein section 15 this ordinance shall take effect on the day of ordinance making it unlawful awful to allow rs to play PI pool or r billiards to be in pool or billiard halls unless accompanied by parent and providing penalty for the board of county commissioners of sevier county state of utah ordain as follows section 1 all ordinances and provisions in c conflict herewith are hereby repealed section 2 it shall be unlawful for any person s on either by himself or his agent servant or employee in charge of any billiard hall pool hall pool table billiard table pool game or billiard game to allow any person under tinder the age of one years of age to engage in any such billiard or pool game to use any such billiard or pool table or to linger in or about the premises where such table is kept or to enter any such hall provided however that it shall be lawful to allow any minor between sixteen and twenty one years of age to play said games to enter said halls to use said tables and to linger in said premises if accompanied by his parent or guardian any person who shall violate any provisions of this ordinance shall be deemed guilty of a mi misdemeanor S and upon conviction thereof shall be punished by a fine of not more than or by imprisonment in
