Show TOWN or JOSEPH WINS DECISION jail has not been built jail lights to be used on streets ruling we reported in our columns once before that the town of joseph applied to the public utilities commission commission for an order to the effect that the telluride power company has to furnish a certain number of street lights to joseph free of charge r the trouble had 0 originated rigina ted when the town of joseph t iad had given a franchise to L L nunn the predecessor in interest of the telluride power company for and ing poles and wires on the streets of joseph for the purpose of supplying the public electric light and power in consideration of the granting of such a franchise mr nunn had agreed to 1 furnish free of charge to the town of joseph sufficient electricity to light its town hall and town jail on condition however that these two institutions be properly wired and equipped at the expense of josepha further condition was included in this agreement to the effect that said lights might be used upon the streets street of the town to the extent of eight lamps of sixteen candle power r each free of charge until t the e town of josph joseph build a town hall and jail neither of which was had at the time of the agreement it so happened that town hall and jail in joseph never bere ere built and the telluride power company finally informed the town board that a c charge h arg a will be made for the street lights light because town hall and jail were here never built this brought the case before the public utilities commission the town board represented by parley magleby claimed d to be legally entitled to the so called free service for street lighting purposes during the term of the franchise while the defendant company represented by attorney H R waldo of salt lake city contended that the promise aromi e to furnish street lights in lieu of lighting fighting city hall and jail cannot be enforced as these two buildings never were erected the public utilities commission did not enter into a consideration of the question of building city hall ball and jail iut b ut on general principles pies decided that the telluride power company has to furnish the street lights for holding the franchise |
