Show Realtor sued in rental dispute ! I The owner of a house on Deer Valley Drive which was denied approval for nightly rental has filed suit against the firm which sold him the house. John Daniels of Mesa, Arizona filed suit in Third District Court in Coalville June 11 against realtor Bob Ziegler and Park City Village Associates asking for $30,000 compensatory and $10,000 punitive damages. In the suit, Daniels contends that, during negotiations for the property at 395 Deer Valley Dr., he talked with an agent for Park City Village Associates about using the house for nightly rental. It was only after buying the house, he said, that he found out he needed a conditional use permit. According to the suit, Daniels' request for a permit was denied by the city on Sept. 19, 1984. On Oct. 22, he said, he entered into an agreement with Ziegler saying Park City Village Associates would lease the house for $1,500 a month from Nov. 5, 1984 to Nov. 6, 1986 excluding the month of December, 1984. That agreement would be nullified by the sale of the property, for a stipulated minimum amount, or by an approval for nightly rental from the proper governmental agency. Daniels applied again for a permit, and was turned down again by the city on Feb. 27 and April 4, 1985. On April 5, the suit says, Ziegler notified Daniels that he would no longer abide by the agreement. In denying Daniels' second application, the Park City Planning Commission cited the steep and unsafe driveway as the reason the property was unsuitable for nightly rental. The Park City Council upheld that decision, with Councilman Bob Wells dissenting. |
