Show Commissioners Respond to City's Counter Claim, Damages Requested The Fire District-Park City-Deer City-Deer valley suit continued this week when attorney Barney Saunders, representing represen-ting the three individual commissioners, filed an answer on their behalf, j In that document, he requested the commissioners be dropped from the suit as improper parties, and further asked they be compensated com-pensated in the amount of $100,000.00 each for the pain and suffering they had incurred by virtue of the suit, as punitive damages. Saunders is representing both the Fire District and the individual commissioners after ascertaining from the County and State Bars there is no conflict of interest in his doing so.. Attorneys for all three parties have met in an effort to settle the suit without the necessity of lengthy legal proceedings, but as yet, no settlement has been reached. Park City, in fact, has advertised for a fire chief in the local newspapers, indicating perhaps they do want to become active in the firefighting business. The suit arose out of the District's belief they have a valid contract with Deer Valley for the land and equipment which Deer Valley Val-ley has to provide for their fire protection. The City says Deer Valley had given the property and the equipment equip-ment to them in exchange Tor the City waiving their impact fees amounting :,to $267,000.00 At the time the suit was filed, the City was under the impression the District was simply leasing the equipment from them at a minimum $1.00 per year rate. When the issue was finally brought to light in a joint meeting of the District and the City Council, the District went back into session and decided to sue to enforce their contract with Deer Valley. Saunders was instructed by the District to file a Petition for Declaratory Judgement. Park City answered the Petition, filed a counter claim and a third party complaint against the commissioners individually. To date, Deer Valley has not filed any papers with the Court, but they have been granted an extension of time to file by Saunders. . In the meantime, Saunders is seeking seek-ing to have the three commissioners dismissed from the suit, which would . leave ojily thereeriginiiL parties.
