Show School Board Continues TMMS Damage Talks In a special meeting of the Board of Education Tuesday, the Board members heard information and made decisions deci-sions on only two matters. (The Board was in executive session both before and after the public meeting, but did not bring any other items before the public meeting.) The first item considered by the Board was that of liquidated damages on the building of the middle school. The Contractor Broderick and Howell Construction Con-struction Company asked the Board for an audience to hear their petition to have the liquidated damages provided pro-vided for in their contract forgiven. The Board had previously taken the position the damage dam-age clause was valid, and they should be paid the sum of $1,000 per day from the date when the contract said the work would be finished to the date when it actually was completed. The date set by the Board as the date when the structure was substantially completed was October 18, 1982. The damages they assert should be paid total $14,000. After considerable discussion, discus-sion, the Board held to their previous decision. However, thev gave the contractor two different options in determining deter-mining the damages, and the contractor is to come before their regular meeting next week with an answer as to which way they want the damages ascertained. The other matter before the Board was the sewage fees which are to be paid for Parley's Park Elementary School. The fees are payable to the Snyderville Basin Sewer Improvement District. After discussion with representatives from Snyderville, Snyder-ville, the Board voted to pav the $79,000. v J |
