The Ordinance prohibits peddlers and solicitors from calling on property posted with "no soliciting" signs. 17. The penalties in the Ordinance are the revocation of the license by the City Council after a hearing, and the citation and trial for a Class C misdemeanor (carrying (carry-ing a fine of not more than $299 and imprisonment of not more than 90 days). Licenses may be revoked or suspended by the Council when the health, safety, and welfare of the community so requires, or when the merchant is guilty of deliberately misleading practices. 18. The Ordinance does not apply to residential garage sales (at private residences, no more often than once per calendar quarter), political actions, religious actions, solicitations on behalf of charitable or civic organizations, organi-zations, wholesale solicitations, solicita-tions, and delivery of goods and merchandise. 19. One is called the Festival Master License, which provides for a general licensing pattern for large scale, multi-party activities acti-vities like the Arts Festival. The license is generally in the form of a contract that covers the nature of the festival and the manner in which it is operated. The second form of license is a street closure permit, which would cover similar items, with the distinction that there is only one responsible party involved. Street closures would pertain to movie making, parades, and some kinds of concerts or performances. Both licenses may require the provision of insurance to protect participants partici-pants and the city from liability to third parties. Public hearings are required before any such license will be issued. License fees are determined by the Council at the hearing on the basis of the real costs to the city in providing excess police protection pro-tection and public works time and equipment in clean-up and preparation. 11. Licenses are to be displayed clearly to the public. Solicitors shall wear a photo identification as to their license; peddlers, food vendors, and street musicians music-ians are to carry their licenses in a manner that is visible which may include wearing a photo identification identifica-tion badge. 12. Any person may hold more than one of the types of licenses established by this Ordinance, or may hold more than one license of the same type, for example, licenses to solicit for different products or companies. 13. Licenses may be denied by the Council or the Finance Department if the information informa-tion in the license application is false or misleading, or if the application conflicts with application previously filed, for exampole two street closure type license on the same street at the same time. 14. Use of public property for private commercial activity, activi-ty, with the exception of the sidewalks in the case of the food vendors and street musicians, shall be by Council action. Preferences in granting licenses to sell food, beer, or other merchandise mer-chandise in the parks shall be granted to charitable or . public service organizations. Public hearing is required. 15. License applications shall be filed at least five days prior to the requested issue date for those licenses not requiring a hearing, and at least fifteen days prior to the issue date for those licenses requiring Council" action. On November 4, 1982, in its regular meeting, the City Council of Park City, Utah adopted Ordinance No. 82-27, 82-27, the title, of which appears. Because of its length , the entire ordinance is not published pursuant to Section 10-3-711 of the Utah Code. 1. A license shall be required to conduct all types of businesses within Park City, whether conducted in the normal retail context or in the form of ' peddling, soliciting, or any other form of commercial activity. 2. All commercial activity, except as provided by this Ordinance or the Land Management Code shall be confined to fully enclosed buildings. 3. Except as provided by the Ordinance, all commercial commer-cial activity shall be confined to private property. 4. Peddlers, who carry goods with them for sale, are permitted to go door-to-door to sell their merchandise. They may not operate from a fixed outdoor location. 5. Solicitors, who take orders or advertise for goods or services, but do not carry goods for sale, may operate on a door-to-door basis, or from fully enclosed buildings with the consent of the owner or lessee of the building. Solicitation from the streets is prohibited, and outdoor solicitation from private property pro-perty is prohibited. Solicitation Solicita-tion from motor vehicles is permissible, but only if the vehicle is clearly identified as a solicitation point, and that no sound amplification equipment or hailing of passers-by is permitted. Real estate sales offices (and the showing of property for sale) and insurance sales are excluded from the definition of solicitors. Solicitors licenses shall be signed by both the solicitor and the authorized representative of the business for which he is soliciting. 6. Street Musicians. Persons may perform theatrical thea-trical or musical performances performan-ces on. public sidewalks, but if there is an expectation or request for valuable consideration consi-deration for the performance, performan-ce, a license is required. Hours of such performances are limited to 10 a.m. to 10 p.m.. unless a part of a community sponsored event or ( cclcbra t ion , i ,No solicita--tiou on. . behalf -of another business is allowed as part of the performance. 7. Street Vendors. Within any commercial zone, persons per-sons selling food or other merchandise from carts or wagons are permitted to sell on the public sidewalks. Persons selling food shall have the approval of the Summit County Health Department De-partment prior to license issuance. There is a ceiling of five licenses, which can be increased by Council action after hearing. Street vendors vend-ors are required to move locations at least once in every hour, and cannot set up in front of other businesses business-es in a manner that inhibits access to the other business. Vendors may, with the consent of the owners, work on private property such as shopping centers, malls, arcades, or on private golf courses. While on private property, they may keep a fixed location. Vendors cannot operate from vacant lots. Vendors may not store their carts or wagons on public property over night or when not in use. Mobile food service vehicles may continue to service construction construc-tion sites, and are not subject to the limitation on the number of licenses. Vendors may not sell beer or alcoholic beverages from their carts or from mobile food service trucks. 8. Convention Sales. As a part of a convention or trade show, persons renting space in the convention or meeting area may sell goods or merchandise at retail, provided provi-ded that they first pay the license fee application to that kind of business under the city's regular business license licen-se ordinance. 9. Outdoor Sales. Any merchant or merchants' association is entitled to hold sidewalk, parking lot, or other outside sales for not longer than five days at a time, and not more than five times per year. Licenses for outdoor sales are issued by the City Council after hearing. hear-ing. Only regularly licensed retailers and their representative represent-ative associations will be issued outdoor sales licenses. lic-enses. Transient merchants may only sell on a door-to-door basis. All outdoor sales shall be limited to private property, except where there is no private setback area, in which case the Council may authorize the use of the sidewalks or the streets. Seasonal plants such as landscaping material and Christmas trees, may be sold from outdoor lots for longer than the five day period, for up to eight weeks, and may be issued to persons other than regularly licensed retailers. re-tailers.
