Show County Bypassed State Offers Clinic Direct Funding Plan The Park City Community Clinic, it was announced yesterday, has been awarded the money obtained bv the state to continue with its program of family planning in Park City. The money which the state will give the clinic represents the money which the clinic was getting directly from the federal government until such funds were cut unexpectedly in September. The funds were to be administered in Summit County in order to meet the standards which the state had agreed to in order to get the monies. The decision, therefore, went to the County Commissioners yesterday yest-erday for their decision as to whether the funds would be administered by the State, the County or the Clinic. The commissioners decided on the clinic. . The funds therefore will be merely passed through to the clinic directly. The funds, however, are in a much smaller amount than the direct grant under which the clinic is still operating. Instead of $54,000 for one year, the yearly amount now available is $35,000. According to clinic director Diana Maxell, the clinic will look for additional funding elsewhere if they agree to accept the state funds. Maxell said they are very glad to have the option open to them of accepting the state funds, but do not want to commit themselves until legal actions which they are anticipating can be completed. The Board of Directors for the clinic has decided, according to Maxell, to appeal the decision of a Washington, D.C. court which ruled they had not been unfairly treated by the government when it decided to cut their funds to the clinic. The decision effectively effect-ively cut off funding to the clinic. The present funding runs through November, and the staff has agreed to continue for an additional month pending the decision of an appellate court. It is the hope of Maxell and her staff that the court will agree to ' hear the appeal as an expedited appeal, which would mean it would be heard during December. A normal appeal could take up to two years to be heard and action taken on it. Attorneys for the clinic are asking the court to hear the appeal on an expedited basis since the clinic would be a thing of the past if it were heard on a regular basis. They claim the clinic has been irrevocably harmed and 1 the actions taken by the government did not afford to the clinic the due process of law. If the District Court agrees to hear the appeal on an expedited basis, it will be heard by a three judge panel in December, with a decision immediately following the oral argument on the case. The clinic is, however, going forward with their budget planning for next year. |
