Show OBJECTION GAS FRANCHISE OVER MAYORS VETO mayor think city was given sufficient rights sidewalk or denance returned at a meeting of the city council last evening the mayor returned the ardi nan co granting a franchise to george A snow for building and operating a gas plant in this city without his approval ho gave as his reasons for not signing the ordinance that it prevented the city from buying the plant until the expiration of fifty years and that it also prevented the city from building a plant of its own in the mean time councilman powers spoke in favor of tho council sustaining its action stating that the ordinance had been roughly investigated and approved by the committee which bad it under consideration he further stated that he ild not believe in taking one mans opinion in preference to the committees report the motion sustaining the councils action was carried moyas and flygare dissenting the mayor also returned without his approval the ordinance regulating permits for building sidewalks in districts which the city has acquired jur tho reasons given by the mayor for his veto being that tho ordinance is identical with an ordinance which the city already has councilman powers contended that the wording of the mayors veto was ambiguous and on motion the matter was le turned to the mayor or additional information on the ordinance granting the right to tho ogden union railway depot company to use a portion of twenty seventh street for the purpose of laying and operating thereon a railroad track was reported by the street committee the committee recommended that the franchise be granted and that those who are interested in the franchise purchase the property in question from whom the protests come tills ordinance gives the right for building a spur from the main line of the union pacific railroad to a place on twenty seventh street near wall avenue where it Is proposed to erect a coal yard A protest came from the property holders adjoining through their attorney valentine gideon who stated that it the coal yards were built and operated that they would cause not only inconvenience and annoyance to adjoining property holders but that the coal yards with their flying dust would cause such discomfort that property would depreciate in value he further stated that the granting of the franchise bould be a privilege to one to the detriment 0 many several property owners wore present and stated their objections to the granting ot the franchise attorney charles hollingsworth spoke in behalf of the petition cis and for the granting 0 the franchise he stated that the property of the protecting parties would be purchased it they desired to se 11 ll at a reasonable price the motion to adopt the recommend batton of the committee was lost by a vote of five to four v protests A protest was received from the taxpayers 0 twenty second street between washington and jefferson avenues protesting against the grade line as established by the city engineer and asking that the same be changed as the present line would mean the destruction of their shade trees along the street and damage to their property on motion the matter was referred to the street committee A protest was received from the property owners on canyon road against paving that street from washington to jefferson avenues on motion of councilman powers the protest WAS referred to the street committee and the city engineer report of city officers robert moyes city treasurer report ed that he had opened an office in the city hall and had appointed as his assistant lewis H carver the ap being made on july 9 and suggested that a salary of 76 per month bo paid mr carver for his services on motion the report was adopted A communication was received from city engineer P stating that the paving on twenty fourth street fc good and recommended that same be not paid for the report was referred to the finance committee pound keeper reported stock in pound since last report sixty three amount collected in fines on motion the report was accepted resolutions council passed resolutions asking board of education to vacate the emer eon school another resolution was passed ordering the said building tp bo repaired and put in condition tora tor a anro station to be known as fire station no 2 A resolution from the committee was passed ordering the work to begin on the paving of washington avenue from twenty sixth street to thirty third street and from ogden alv er bridge to twelfths street councilman powers offered a resolution requiring that the city engineer and street supervisor be instructed to have all opening the city streets for water pipes or other purposes to put alie streets in as good a condition as they found them on motion the resolution was adopted councilman powers offered a resolution which was adopted requiring tha electric light company the bell telephone company and thes independent resolution was adopted mr thomas offered a resolution an thorl zing the water commit pur chase two now water founts the resolution was adopted dr dackson biado a resolution order ing the street committee to repair the holes in the paving on Twenty fifth street the resolution waa adopted petitions W H scudder and D M robertson were each granted a liquor license i A petition was received asking that W J be reinstated as a city police officer on motion the petition was referred to police committee A petition signed by joseph stanford chairman io county board of commissioners asking for permission to build detention house for persons affected with contagious diseases was referred to building and grounds committee with the sanitary committee added K petition from james mcbryde asking for permission to operate a merry go round on the northwest corner 0 the city hall square was re fused A petition was received from fore paugh sells show company asking for a city license to show in this city july 31 on motion the license was granted in consideration of fee the building and grounds committee reported that it had rented a part of the city hall square to L P dignall Dign aln nt 3 per day for show purposes on motion the action of the committee was not sustained and it was decided not to rent the grounds to this party for a longer period than one week |
