Show CONTEST BEFORE SUPREME INVOLVES JUDGESHIP the suit on behalf of H H t against the successful Success fu candidate J A howell 1 at an adjourned session of the su court yesterday the arguments in the election contest case of manlel hamer contestant and appellant vs J ai honeil which involves the judgeship of the second district court were heard the circumstances leading up to tha case are well known having been thoroughly aired at the time of the hearing in the lower court according 40 the returns as canvassed after the last election by tho commas of the three counties that compose this district judge howell was elected by a plurality votes the case was first heard by judge 0 W horse cf salt lake who declared judge honeil elected by votes it having been maintained by the contestant that the board of canvassers counted several alleged illegal votes in his favor and further that he was disqualified from holding the office because he had violated the election laws by offering positions to parties in order to secure their votes the lower court also ruled against the contestant on the latter point who thereupon an appeal to the supreme court in appealing the case the contestant alleges that the court erred in that it counted balloid in judge howells favor which should have been declared illegal and also in its decision in regard to judge howells qualifications to hold office in their arguments yesterday it was stated by the attorneys for the contestant that in the former hearing the contested conte did not contradict the latter point and they also set out that prior to the election judge honeil personally promised samuel L dyo a position as assistant court stenographer and stated that he would secure for J D akcen the appointment as municipal judge provided they would support him in the election the arguments will not bo concluded until some time this afternoon |
