Show THE arbitrators thirtieth street awards set aside attachment issued fop ono of tho witnesses C L darlane admits that the arbitrators never old sit as a court to hear protests or notify abo property holders to appear f when TUB first started the investigation of the thirtieth street awards a month ago it waa believed by some that it was a big bluff the investigation vesti gation went on however and as it progressed tho evidence 0 croaa error if not actual fraud became apparent that the matter could no longer be ignored and the present city council no pointed a committee to make an investigation and upon that committees final report the city attorney was authorized to begin proceedings to revoke the awards made by the arbitrators which was done the matter culminated yesterday in the fourth district court when the cause of in arbitration re between city and G II 11 matson was called for trial before judge miner the heal ing was brief only two witnesses being examined alfred empey one of the thirtieth street property owners and 0 L darling one of the arbitrators sir testimony was practically alie same as that published in THE STANDARD in the beginning of the investigation vesti gation and afterwards given before the council committee and need not be republished here 0 L darling did did not respond when birot called upon and the following order was made it appearing to the court that 0 L darling a witness duly subpoenaed has not appeared it is ordered that an attachment issue for eaid witness mr darling subsequently appeared and testified that the arbitrators did n ot eit as a court or board of arbitration to hear protests or statements from pro perty owners and did not notify them to eo appear the court then ordered that the awards be set aside and the arbitrator a be removed |
