Show REMAINS OP OF THE TIMES pollock and others sued by former partners lato late yester yesterday dj afternoon in the third district court E G ivins 0 0 cline clino and A F phillips P who tr together gether with A L pollock w were ere partners under the firm name of A L pollock filed ft a suit against again stAL A L pollock who refuses to join the other plaintiffs in the suit II 11 coln L britton and tile smythe britton company plaintiffs allege that in the year 1892 they were associated together for the publication of the salt lake times under the tile firm name of A L pollock lc lessee see and that the profit arising from eaid said business was to bo be div divided aided ibis then stated that thit on jul p 1892 the plaintiffs entered into an agree 1 non with L R britton for the publication of the paper and that B britton rit was manager of the tile defendant coli company ny thereby binding the latter t to said agreement and that the publication was then begun by the said britton that the company then thea continued to publish said newspaper new newspaper until november 15 1892 when they cea ceased sed the publication li of said 1 paper aper without notice to the plaintiffs or pollock as required by their agreement to the damage of said firm in the sum of 2000 that during the publication of said paper under tile terms of said agreement the defendant company received large sums of money for advertising and from other sources amounting to many thousands of dol lara lars but that no accounting lias has been made mado to eaid said plaintiffs or to the firm of A L pollock also that large sums of money as pecuniary profits were contributed tri buted by citizens for the use and benefit of the publishers of said paper plaintiffs further aver on informal tian and beli belief ef that the total amount of money thus received was about and that said sum should have been di i vided between plaintiffs and defendants but that no accounting lias has e ever v er been made also that there is now d due ue plaintiff from defendants defon danta the sum of together with a largo large amount due from other sources upon these allegations plaintiffs pray that ai an I 1 accounting may way bo be had and the defendants be compelled to account to any and all sums of money that may have halo been received by them as pecuniary benefits arising from the publication of the said newspaper and that the same may bo be divided between plaintiffs and defendants also that pending this suit a receiver may be appointed to take charge of the we business asse assets jis book accounts etc of the smyth britton company powers hiles arc are the plaint plaintiffs effs iffs at torness tor |
