Show JUSTICEJMID T. F. Marsh Applies to District Court at Salt Lake for Writ of Certiorari SALT LAKE, Oct. 23. Another victim vic-tim of C. F. Durand. erstwhile Justice of the poaco at Murray, ha3 appealed to the district court for relief. T. F. Marsh, against whom a judg- mcnt of $43 10 for debt was entered by Durand In January of 1907. lu favor of A. Madsen, applied to the district court Saturday for a writ of certiorari to compel Durand and hla successors to submit a record of all the steps in tho case against Marsh for review. Marsh says that ho was given abso-lutcly abso-lutcly no notice of the caso aginsthim 1 from the time It was filed until the Salt Lake Route, for which he works notified him October 15, this year, that a writ of garnishment of bis wages. TheQ h0 I employed an attorney, who looked into tho caso and found that the complaint, com-plaint, which was not erlfled, falsely set up that the Indebtedness was Incurred In-curred at Murray, to make It appear that Durand had Jurisdiction, when In fact the obligation was made at Mi. Pleasant, Sanpete county. Marsh also wants Durand's eucces-sorcs eucces-sorcs restrained from further action upon the allegcvl Judgment entered against him and the pretended Judgment Judg-ment finally set aside by the district court. |
