Show NICARAGUA'S NEW CONSTITUTION New York, Oct. 10 A copy of the constitution promulgate. by the provisional pro-visional government of Nicaragua has Just been received in New York. A translation of the instrument shows that it 'differs in scceral Important respects from the constitution iu effect ef-fect during the thlrte?n years of. the Zelaya rule It grants to the pliplc a greater degree of liberty than they ever before onjoed. and lessens the possibility of a repetition of the dictatorship dic-tatorship under which the republic suffered during the Zelaya regime. The preamble reads: 'During the administration of Oen-eral Oen-eral J. Santo 5iclaa and Dr. Jose Madrlz, the constitution and laws of the republic never had elfectlve ap- plication because in that time the arbitrary ar-bitrary will of the filers always prevailed pre-vailed in all the branches of public administration. The undersigned desires de-sires to adapt all his acts In conformity con-formity with a rule that guarantees public liberties and the independent exercise of the judiciary power, In which a complete chance must be made in the. personnel of the past rule, for the scandalous demoralization demoraliza-tion of the administration of justice was notorious." Article six. divided Into sixteen paragraphs par-agraphs gives to the Nicaraguans certain cer-tain rights which heretofoie they have never known The first paragraph grants to all liberty, individual secur-' Ity an.l equality. The right to exercise exer-cise the write of habeas corpus is also given. The new constitution establishes estab-lishes the right of defense and jury trial and of the publicity of hearings and guarantees the piivacy -it b-tter and telegraphic communication. There will be no death penalty or punishment punish-ment by the lash or other torture. Article nine alms to do away with the Zelaya practice of arbitrarily ex llinK pet sons from the territory for -personal reasons and for indefinite periods. It reads: "The expulsion of a Nicaraguan from the territory of the republic may be not decreed except for justlliahle cause and in ihe council of ministers and Mich term of exile shall not exceed six mouths." |
