They also set forth in the notlec that they were discharged without cause. Arthur Woolley, Ogden attorney, appeared ap-peared In behalf of the discharged officers of-ficers lost night and presented the notice for appeal. Samuel C Powell, assistant elty attorney, appeared for Ogden Cltv CHIEF M IKES REPOB I No investigation of the charges was begun last night, but the commission received a report from Chief Jones I in which he set forth all the alleged j facts leading up to the discharge of the ufflcers. It Is understood that witnesses will be produced at the hearing tomorrow afternoon to substantiate sub-stantiate the charges contained in the report, which follows. In full. Elam and H 11 Butler I from the pollee department "Harry B. Elam was dismissed j January 2G. following an altercation ' with Sergeant Stephens. "The first Insubordination on the I p.rt of the officer occurred in October. Octo-ber. 1921. Chauffeur Hawkins reported re-ported to Sergeant Stephens that lie had found Klam in the Elite cafe about 6 o'clock In the morning In an intoxicated ondltlon ind that he jook him home in the police auto. "The next time was on Christmns eve when ho called Sergeant Stephens on the telephone and stated that he had a little party at home and wanted to be excused for an hour or so. He was Informed by the sergehnt that owing to it being holiday time and lots of people on the streets and a shortage of officers, chat he had better bet-ter report for duly. He replied that he would do so. He did not report at the station and the red Signal light used for calling officers at night, was flashed at two different intervals for long periods, but Elam did not answer. an-swer.
