Elam and Butler Retain Attorney At-torney to Appeal From Dismissal HEARING ON TONIGHT Commissioner Says He Will Stand Back of Sergeant Until Mistake Proven Patrolmen H. E. Elam and H H Butler, who were discharged from duty with tho Ogden police department Saturday by Chief of Police Jonathon Jones, as the result of an allowed altercation al-tercation early last Thursday morning with Folic- Serg-ar.t A. H. Mr, I 'o Wolf notified the two discharged discharg-ed officers that the board would take up their case tonight ln tho city hall .it 7 30 at tho regular meeting and told the men to be present to give their testimony. In th-lr appeal the officers doclar-ed doclar-ed that they were discharged without cause and they desired that the entire muter be nlred before the commission. Arthur Woolley, Ogden attorney, has been retained to represent Elam and Butler at tonight's hearing. .CCUSATIOXS MADE Elam and Butler made statements Saturday in which they declared that after they had raided a Japanese and Chinese gambling house shortly after midnight Thursday morning, and had arrested several gamblers. Sergeant Stephens suddenly accused Elam of smelling of liquor and told thorn that they were Incapable of making further raids that night. A heated argument Is said to have arisen between Elam and Stephens, which resulted in Stephens ordering Elam to turn ln his equipment. Detective Jones Jumped between the two and persuaded persuad-ed Klam to take the cartridges from his revolver. Butler is said to have upheld Elam In the argument and to have thrown down his badge and gun. but later, upon up-on orders of Sergeant Stephens, patrolled patrol-led his beat that morning. Stephens reported the matter to Chief Jones, who conferred with Commissioner Com-missioner J. Ray Ward, with the result re-sult that the discharge of both officers offi-cers was made Saturday. Stephens reported re-ported that he had cautioned the officers of-ficers before about drinking. Commissioner Ward said today that he had upheld th- actions of Sergeant Stephens, because it was necessary to -i.md behind the authority given by him to his officers ln order to bring about proper functioning of the police po-lice department 11- said he would continue to stand behind this action until he had been convinced that an error hod been mad- Commissioner Ward further said he was glad the matter was to come before be-fore the civil service commission for the reason that all details would then be brought out and it would bo pos-Hibb- to definitely den rmlni if a wrong had been done the discharged officers.
