Was Overpaid With two poHitions to bis credit and after receiving two checks for work at the state legislature. I. N. Pierce yesterday returned one of the two checks to the state auditor with (he following statement "I am returning this check properly endorsed to tho treasurer of the state of Utah, the reason for such action Is according to the decision of our attorney attor-ney general (Shield), which was that I was disqualified by having accepted a position as inheritance tax commissioner, commis-sioner, the salary of which is paid bv the state of Utah. Consequently, I was being paid by the state From two sources, which is prohibited bv the laws of our state. Kindly see that the fund from which it was drawn receives proper credit "
