Suit was filed yesterday in the Third district court against David Mattson, the Kenyon 1 Hotel company and the Merchants bank by Mary Llston, guardian ad litem for Estella O. Panushka, to recover re-cover 10,000. i, The plaintiff alleges that the defendants de-fendants took advantage of her ward to induce her to sign a note for the ; amount in their favor. The complaint alleges that Estella O. Panushka Is not mentally competent to undertake the conduct of her business affairs and says that this was taken advantage advan-tage of by the defendants. The complaint alleges that J. H. Carney, who recently leased the Kenyon Ken-yon hotel, assisted in inducing the woman to sign the note, appealing to her on the basis of old friendship. The note is alleged tot have been executed ; in Salt Lake and to have become a J matter of record in Beaverhead coun-I coun-I ty, Montana. The execution of the 1 note, according to the complaint, was I under date of May 18, 1916. |
