Show CHARGED WITH THE TAKING OF LUMOFR FROM THE YARDS P. L. Barton of west Ogden was tried in the municipal court this morning on petit -larceny. He was arresten yesterday on a complaint, charging him with having stolen two pieces of car flooring from the Oregon Ore-gon Short Line Railroad company. The city's witnesses were special Officers Knowles and Shoemaker of the Oregon Short Line. They testified testi-fied that they had found the lumber lum-ber In question at Barton's home, that they had questioned the man as to where he got it and that he admitted ad-mitted taking it from the railroad yards. They also Identified the lumber lum-ber as tielng the property of the railroad rail-road company, as It was a type of lumber that 'cannot be purchased on the market being made for the special spe-cial purpose for which it' is used by the railroad company. Mr. and Mrs. Barton testified for the defense. Barton denied the statement state-ment of the officers regarding his having admitted that he took the lumber. He 6ald that he told them that the lumber looked like lumber that he had seen in the yards. The lumber In question, he said, had been taken from a car of can6 at the Syracuse Syra-cuse canning factory and had been brought to him by his father, who is manager of the factory. He explained that it was the custom of the factory people to brace the cans in each end of the car with lumber and that, when the cars were unloaded, the lumber was thrown out as waste and was generally used as kindling by people who happened to pick it up. The case was taken under advisement. |
