TURNER FORGERY CASE District Attorney John C Davis ap peared before Judge James A How ell this morning and filed a statement, rather than an Information In the case of the state against J J. Tiirnpr charged with forgery In sixteen different dif-ferent counts, the statement setting forth that there is no available evl dence upon which assurance of conviction con-viction can bo based Turner was bound ovpt to the district court Oc tober 22 by Judge W. H Reeder of the municipal court In presenting the statement the district attorney recommpnded that Turner be released from custody urg ing the court, however, to make a complete investigation in the case be fore the order of release be made He suggested that the attorney for Mrs Turner and the defendant, J J Turner, Turn-er, be advised of the Investigation, and that Charles H Barton cashier of the Ogden Savings bank Clerk Sumnr Nelson of the same bank, k. A Moyes, cashier of the Commercial .National bank, and Ralph E. Hocg, cashier of the Utah National bank, be subpoenaed as witnesses on hand writing that the court may be more fully advised as to the situation re garding a prosecution for forgery. The court complied with the request re-quest of the district attorney and made an order that the parties be summoned into court tomorrow morning morn-ing at 10 o'clock. The statement of the district attor ney was but a relterai Ton of what was published In the Standard yesterday aflernoon. to the effect that the wife could not be compelled to testify In the caHe except by the consent of the defendant, which consent he refuses to gne. The defendant denies the forgery and toe cashier and clerk of the bank say that the orders upon which the money was paid to Turner were not forgeries Judge Howell stated that he was Inclined to make the order releasing the defendant from custody Instanter but would act under the suggestion of the district attorney to hold an investigation, in-vestigation, inasmuch as there are evident evi-dent legal complications in the case. The attorneys for Mrs. Turner are Valentine Gideon and J. N. Kimball, and the attorney for Mr Turner is James H DeVine. Mrs. Turner denies the signature jn the various orders for money upon which money was paid to her husband while the husband claims that she signed the orders and sent him to the bank to get the money. The signature on the various orders will be examined by experts at the hearing tomorrow. |
