Mr. Guernsey commenced suit against the defendant to recover lioo damages for the alleged infringement on the part of defendant of his trade mark, "The Goodyear Repair company," compa-ny," also complaining that the defendant defend-ant had used the plaintiff's sire' number, on Twenty-fourth itree; to plaintiff's disadvantage and damage dam-age The infringement was alleged to have occurred In the early pari of this year The parties are engaged In the shoe repairing busine-s on Twenty-fourth street, between Urant and Washings i avenues, the plaintiff on the north side of the street, ami the defendant on the south side.
