Show ANOTHER BECK CASE IN COURT in which ogden people are defendants fend ants john beck the bankrupt mining man sues to decover Cola teraI case now on trial before judge hiles the trial of the case in which john beck is plaintiff and david eccles and george E romney doing business as the pacific lumber company defendants and arthur A steed and R J taylor was begun yesterday afternoon before judge alles in the third district court at salt lake according to toe allegations of the complaint beck executed a promissory note payable to the defendants for and pledged to secure the payment of the note chaj cs of the capital stock of the black pine mining company the dividends on 2000 shares of bullion beck stock a deed to certain property on quince street salt lake city and a deed to a grape farm in utah county defendants afterward satisfied a judgment against beck in favor of lucinda A hebscher Leb or 1510 which was added to becks former indebtedness debt edness of T SIRS CLAIM the defendants it was also alleged obtained from mrs sarah everhard shares of stock of the buckeye mining company shares of bul lion beck tunnel company stock shares of crown point company stock and ten shares of ashley coal company stock which beck had given to mrs everhard as security lor an indebtedness beck also alleges that in ignorance of its meaning and import he signed a confession of judgment in favor of the defendants and an agreement by which he was to give tho defendants a bonus of for allowing the judgment to run tor six months and agreed that at the end of that time it it was not paid he was to relinquish all his title and interest to the security which was to become itie property of the defendants at stated prices in satisfaction of the judgment beck further alleges that the agreement was fraudulent and void and prays that it be eo declared and that upon payment of the amount duo the defendants without any bonuses he have the securities back CLAIM the intervenors claim a subsequent interest in the securities and pray that the defendants he required to render an accounting the defendants denied that beck did not understand the contract regarding the sale of the securities but on the contrary they allege he signed it after it bad been approved by his attorney they deny that the contract provided for any bonus as alleged by beck and aver that the additional sums were tor additional indebted nesses judge henderson and attorney A T conducted the case for E W wilson trustee in bankruptcy of beck and attorneys J H moyle and lindsay rogers were tor the defendants |
