Baker forcibly took Foster before Judge Joseph Markoy of the criminal couit and asked for protection today. Judgo Markoy, who was conducting a murder trial, loprlmaudcd tho prosecutor pros-ecutor for Interrupting, but Mr. Baker persisted aud, snatching a club from a policeman, threatened Foster. Court officers drew Baker away and Judgo Markoy ordered him to appear In couit tomorrow to show cause why ho should not be held in contempt, Tho Judgo took no cognizance of tho charge against Foster. Immediately after tho incident Baker was subpoenaed to appoar before be-fore the federal grand Jury tomorrow to testify lu the government's inquiry in the dynamiting caBe. The encounter between Baker and Foster was the rosult of fiiction between be-tween tho prosocutor and Foster's superior, su-perior, Walter Drew, counsel for the Erectors' association Drew had said Baker had been negligent in pressing the investigation locally and Bakor resisted successfully In the county court the effort of Drew and the county prosecutor of Los Angeles to remove to Los Ange'ea books and papers of the association of bridge and structural Iron workers, now In the hands of the federal authorities. Saying he wished to know if Drew had any new Information about the dynamiting cases, tho piosecutor summoned sum-moned him to appear before tho county coun-ty grand Jury.
