Hunter, H defendants In tho suit of tho Rocky H Mountain Stud Farm company against H H. H. Lunt et al, have been given per H mission by Judge Howell to fife a com- H plaint in intervention, setting forth af- H flrmatively that, according to the H terms of tho original complaint, they H arc not proper parties to the action H and are not concerned in tho contro- H In this case there are twenty-nino B defendants named, all of whom reside H at Cedar City, Iron county 300 miles H from Ogden, and If the case is brought B to trial hero all tho defendants and a H small army of witnesses will have to H travel that distance. It was stated in H an affidavit for a change of venue that H it would cost about $15 each to make H the trip. Tho attorneys say that It H will require at least four weeks' tlmo H to hear tho case. H The suit grew out of the sale of a fl stallion to a joint stock company of H Cedar City by the plaintiff, tho com plaint alleging that full payment has not been made on the note which was Issued by the company, the amount Involved being In the neighborhood of $2,000. The note was made payable at an Ogden b,ank, which gives the court of this district jurisdiction The defendants have asked that the case be transferred to the Iron county court on the grounds that nearly all the parties concerned reside in thaj. district and that to hear tho case there would greatly reduce the expenses expen-ses of tho trial. The defendants deny that there is anything due on the undertaking, un-dertaking, but that, on the contrary, the plaintiff Is indebted to the stock company something over $1,000. |
