Hollingsworth against the Salt Like & Ogden Rail-wny Rail-wny company In the District court, has been given another backset because be-cause of. the Illness of Juior A. A. Wcugcr. It was stated by the court that Mrs. Wenger had again advised tho court of the Inability of Mr. Wenger Wen-ger to attend the trial, saying that a doctor had been consulted and he had stated that it would be impossible for Mr. Wongcr to do jury sorvlce during the day. Judge Howoll stated thnt a recess would ho taken 'until two o'clock In the afternoon and that, In the mean timo, the consulting physician would bo (ionforred with regarding Mr. Wengcr'a condition to find out, If possible, whether there Is a likelihood likeli-hood that Mr. Wenger will he ablo to hear all of tho testimony in the case. If it Is learned that the Juryman may be prevented from attending the case at Intorvals through tho trial, the attorneys at-torneys will be asked to agree to proceed with the hearing with the remaining re-maining seven jurors or get a new Jury. |
