Show election this year one of great importance the election this november la is one ot of the most important ever held in the state inasmuch as a fundamental policy in regard to the regulation of 0 the manufacture possession use and sale of alcoholic liquors will be determined the decision 0 of the majority of 0 the electorate will be binding tor for an indefinite future time hence the necessity that we all understand der stand the issues presented and problems involved the repeal of the article of 0 amendment to the federal constitution must be taken as an established fact act in forming the policy to be adopted in utah vote on the federal question is ot of importance only to itself the end of the questionable amendment to the federal constitution atit ution is assured by the vote of slater sister states therefore wo must commence any discussion on the basis that the new article of amendment men dment will immediately replace the amendment and will define the federal governments new position on this question any other assumption would bo be false also and lead us into a morass of greater confusion than now exists we must face the tact fact that federal prohibition is gone and must shape our course accordingly utah is in a fortunate position in this regard and can do constructive work for the common weal we have had bad in this state three kinds of prohibition hibi tion first federal prohibition as represented by the amendment and the Vo istead act secondly state constitutional prohibition its as ordered and directed by sec 3 art lele icle of thel the organic act ot of the commo commonwealth i wealth and thirdly statutory prohibition as set forth in the statutory mandates ot of the legislature with the esth amendment set aside utah must now determine for itself its own domestic policy this Is the solemn duty ot of all citizens when they enter the voting booth on november ath in approaching the problem certain basic facts must be emphasized and thoroughly understood to ignore them or misunderstand their portent can only produce dire and unfortunate results it Is now proposed to repeal the bone dry clause ot of the state constitution ution and the voters have been baen offered the opportunity to do so at this november election it la is not proposed to repeal statutory prohibition or the enforcement cat the voters cannot do that directly by repealing constitutional prohibition the legislature Is restored its original power and authority on the question and thereby we are placed in a position to meet the problems of the future it constitutional prohibition remains we have no alternative but to attempt the enforcement thereof it if constitutional prohibition is eliminated the mandates and prohibitions of the enforcement act remain but the legislature will then possess the right and authority to amend change or sustain it as in its judgment the situation demands this tact fact must be made clear that the striking of the bone dry clause from the state stata constitution will not leave utah wa wide do open there will remain effective and operative until changed by the legislature the identical prohibition and enforcement act which Is on the statute books today it if the policy of prohibition in utah Is correct then it will continue tor for there will bo be a period of nearly fifteen months during which tho the prohibition law and enforcement act will bo be operative before it can be altered by the 1936 1935 legislature in regular session if it provides the means whereby the now new conditions arising out of the repell of the amendment cark can bo be met then it will remain on the statute books as the law of the state can a fairer plan be d devised e it if tho the policy of prohibition Is 4 right under the now new conditions it has the opportunity to vindicate itself can anyone demand more thin than this it if it Is wrong then the leggo legislature j fully restored to its origin al constitutional power can alter and a 6 ment it in its wisdom the plan proposed A by us Is not radical but conservative serva tive in the extreme we ais are willing to give prohibition la in utah ta on more trial when we str strike ike the bone dry clause from the state constitution constitute on we are simply limply restoring the government to tho people they canthon can cair then through their elected representatives indicate the plans and policies they desire followed in this commonwealth we are all laboring ions vastly different from those that existed fifteen years ago when the bone dry clause became part ot of the state constitution it may be safely said that the proponents of that clause could boand did not fore see the economic and social conditions as they exist today I 1 question very seriously it if they had bad possessed the power to read the future that they would have advocated such a measure the voters will simply remove from the constitution a misplaced sumptuary provision and restore to the legislature its original power we will then be able to face the present presen tand and future problems with a machine which can be readily adapted to the
