Show HOMESTEAD RESIDENCE UNDER TREE HELD LEGAL An Interesting decision, and one that will prove of interest to all the homesteaders over the west, was made this week by Register Skinner and Receiver Bruce of the U. S. land office at Montrose, as it established the rule that homesteader may claim residence on his land even though temporaly he is . housed only on-ly under the limbs of a tree. it is the case of Craig A. Goodwin vs. Raymond G. Weiser, over a 640 acre homestead entry 6. miles from Sapinero. The contest was waged on the ground that Weiser na(l not es tablished residence or built a house. As evidence that he had acted in good faith, he showed he had lived under a. tree, for two or three, months making it his home, and then later he built a cabin. The register and receiver re-ceiver held that there was no evidence evi-dence at all produced that. Weiser did not really establish a. residence, and his own testimony that he did so, though not in a house, was taken tak-en as evidence thta he lived on the land, and his erection of a cabin later la-ter indicated his g oodfaith.
