Show 70-Car Law Held Unconstitutional Master In Chancery M. A. Dis-kin Dis-kin Saturday held the Nevada train-limit law unconstitutional in a lengthy report submitted to the federal court recommending that the Southern Pacific's injunction against the law be made permanent, perman-ent, according to a news dispatch from Carson City, Nevada. Diskin held that the law directly violated the constitutional provision pro-vision giving congress the right to regulate interstate commerce and the due process clause in the 14th amendment because it would place a heavy financial burden on railroads rail-roads by fixing the train length in other states. Replying to trainmen's conten-i conten-i lions that the 70-car train limit w-as a safety measure, Diskin said: "The law does not bear a rea-i rea-i sonable relation to the health and s.ifety of workers and wouldn't ! eliminate any existing hazards but .would create others".
