Show AN OPINION FROM ATTORNEY GENERAL BARNES. The school board at Kanosh sent to Attorney-General Dames for an opinion opin-ion as to who were qualified, voter entitled en-titled to vote on the question of school consolidation. The opinion given is that a person Is not. entitled to vote unless his name appears on the registration list, and In order to arrive at a "proper understanding under-standing of the question it would be necessary for the County Commissioners Commis-sioners to whom the petition must be presented to go to the registration lists containing the names of all persons per-sons found thereon. The statute makes no provision for the registration of voters between the last general election in a county and the time for petitioning the commissioners commis-sioners to organize a school district, and there is only one way to determine deter-mine whether a person has a right to vote or not, and that Is by resorting to the registration lists. The right t opetltlon for or against consolidation continues as long and may be exercised as frequently as a sufficient number of voters desire to petition the commissioners in that be. hair. While there Is no statutory provision allowing challenge of petitioners yet If any person has an Interest In the quern Ion of organizing school districts should raise the question of the petitioners peti-tioners right to ask the commissioners commission-ers for such organization, the commissioners commis-sioners would undoubtedly have the authority to question the petitioners' right and pass upon his qualifications. We publish the above at the request of J 8. Dorlty, one of the school board, and are glad to give both to friends and opponents of consolidation consolida-tion an opportunity to know who are entitled to petition for or against. But we are more anxious to know, and we asked Mr. Dorlty to give, the reason why Kanosh and some other places are opposed to consolidation. We have published a good many arguments argu-ments In favor. We are Just as ready to publish the arguments of those opposed. op-posed. The general opinion is that opposition Is solely on the selfish grounds that the opponents have good school and do not want to be'taxed for putting up better schools for poorer districts. A man might Just as well object to paying school taxes because be has no children, or refuse to pay a road tax because there are good roads In front of his farm. If there are valid objections to consolidation we want to bear them. If they cannot be answered to the satisfaction of the majority of the registered voters consolidation con-solidation should not pass. Come Toi. ward with your objections. |
