Show LEGAL DEPARTMENT Bond No (Fac-simile signature) City Treasurer. There shall be endorsed on each of said bonds the following: "I hereby certify that this bond is within the lawful debt limit of the City of Gunnison, Utah, and is issued according to law. City Recorder." Section 2. The interest falling due on said bonds on. the first day of December, De-cember, A. D. 1931, and the first day of June, A. D. 1932, together with $1,000.00 principal amount falling due on the first day of June, A. D. 1932, shall be paid out of the general fund of said City, and for the purpose pur-pose of reimbursing said general fund for said payments, there shall be levied by the, City Council of said City on all taxable property in said City, in addition to all other taxes, a direct tax in the year 1931 sufficient to produce the principal and interest so paid on said bonds; and to meet the principal and interest payments on said bonds as they become due thereafter, there shall be levied by the City Council of said City, on all taxable property in said City, in addition ad-dition to all other taxes, a direct annual an-nual tax in each of the years 1932 to 1960 both inclusive sufficient to pay the principal and interest on said bonds as they fall due in each of said years. Said taxes, when collected, shall be of bonds numbered from 1 to 30 both inclusive, to Snow, Goodart and Company, Com-pany, of Salt Lake City, Utah, and the action of the City Council in accepting ac-cepting their bid and all acts and proceedings pertaining thereto are hereby considered and are hereby ratified and confirmed, and the City Treasurer is hereby authorized, instructed in-structed and directed to deliver said bonds, when properly executed, to said Snow, Goodart and Company, upon receipt of the purchase price thereof, with accrued interest thereon there-on at the rate of four and three-quarters three-quarters (4 per cent) per annum from date of said bonds to date of delivery, in accordance with the terms of said bid. Section 5. WHEREAS, it is necessary neces-sary for the immediate preservation of the peace, health and safety of said City that the proceeds of these bonds be available immediately for the several purposes herein set forth, NOW THEREFORE, IT IS ORDAINED, OR-DAINED, that an emergency is hereby here-by declared and that this ordinance ishall be in force and take effect upon the date of its passage, approval and publication. The City Council shall annually levy a tax sufficient to pay the interest in-terest on this bond as it falls due and also to constitute a sinking fund sufficient suf-ficient to pay the principal when due. It is hereby certified, recited and declared, that all conditions, acts and things essential to the validity of this bond exist, have happened and have been done and that every requirement re-quirement of law affecting the issue thereof has been duly complied with and that this bond is within every debt and other limit prescribed by the Constitution and Laws of said State of Utah. The full faith and credit and all taxable property within the limits of said City, as constituted at the time of the issuance hereof, are and shall continue to be pledged to the punctual punc-tual payment of the principal and interest in-terest of this bond. IN WITNESS WHEREOF, the City of Gunnison, has caused this bond to be signed by its Mayor and City Treasurer and its corporate seal to be affixed hereto, attested by its City Recorder and the annexed coupons cou-pons to bear the fac-simile signature of the City Treasurer as of the first day of June, A. To each of said bonds shall be attached at-tached a coupon for each' installment of interest contemplated by said bond, which said coupons shall be numbered consecutively beginning with No. 1, with the several dates of payment and number of bond, and shall bear the fac-simile signature of the City Treasurer, said coupons, and each of them (except as to date of payment and number) shall be in substantially the following form, to-wit: (Form of Coupon) No $23.75 On the first day of June-December, A. ORDINANCE NO AN ORDINANCE PROVIDING FOR THE ISSUANCE AND SALE OF THIRTY THOUSAND DOLLARS '($30,000.00) WATERWORKS BONDS OF THE CITY OF GUNNISON, GUN-NISON, UTAH: WHEREAS, by the result of a special election duly called and held in the City of Gunnison, Utah, or Saturday, May 9th, 1931, said City was authorized and empowered to issue is-sue and sell $30,000.00 Waterworks Bonds, and WHEREAS, the result of said election was declared by the City Council of said City, sitting as a Board of Canvassers, by resolution duly passed on Monday, May 11th, 1931, and WHEREAS, Snow, Goodart and Company, a Utah Corporation, has offered to purchase all of said bonds, paying therefor par and accrued interest in-terest from date of bonds to date of delivery thereof, which bid was the highest, best and most advantageous to said City and which bid has, by resolution, been duly accepted by the City Council, NOW, THEREFORE, BE IT ORDAINED OR-DAINED BY THE CITY COUNCIL OF THE CITY OF GUNNISON, UTAH: Section 1. That for the purpose of raising funds to defray the expense of increasing, improving, enlarging, extending, perfecting and adding to c- the present' waterworks system of said City and securing an additional addition-al water supply for the purpose of i supplying and distributing water to the inhabitants thereof, which said , water system and works shall be I owned and Controlled by said municipality, muni-cipality, in manner provided for in a resolution passed by the City Council- of said City on the 4th day of April, A. D. 1931, providing for and ordering a special election for the purpose of submitting to the qualified quali-fied electors of said City the question ques-tion of incurring a bonded indebtedness indebted-ness to the said amount of $30,000.00, the City of Gunnison, Utah, does issue is-sue $30,000.00 Waterworks Bonds, of . ..-the denomination of $1,000.00 each, numbered consecutively from 1 to 30 inclusive, to be known as "City of Gunnison Waterworks Bonds, Series of June 1st, 1931," to be dated June 1st, 1931, to bear interest at the rate of four and three-quarters per cent (-!' per cent) per annum, from date until paid, payable semi-annually on the first days of June and December Decem-ber in each year, the principal to become be-come due and payable serially as fellows: $1,000.00 on the first day of June in each of the years 1932 to 1961 inclusive, all payable at the Guaranty Trust Company of New York, in New York City, N. Said bonds, and each of them, shall be (except as to consecutive numbers and date of payment) in substantially substantial-ly the following form, to-wit: UNITED STATES OF AMERICA STATE OF UTAH CITY OF GUNNISON WATERWORKS BOND SERIES OF JUNE 1, 1931 No $1,000.00 KNOW ALL MEN BY THESE PRESENTS: That the City of Gunnison, in Sanpete San-pete County, Utah, hereby acknowledges acknow-ledges itself to be indebted, and for value received hereby promises to pay to the bearer hereof the sum of ONE THOUSAND DOLLARS ($1,-000.00) ($1,-000.00) in Gold Coin of the United States of America of the present standard of weight and fineness, on the first day of June, A. D. 19 , at the Guaranty Trust Company of New : York, in New York City, N. Y., with interest thereon at the rate of fourj and three-quarters per cent (4 per cent) per annum, from date until paid, payable semi-annually in like money on the first days of June and December in each year, said interest to maturity being represented by in-i in-i terest coupons hereto attached. This bond is one of a series of 30 bonds of like date and amount, numbered num-bered from 1 to 30 inclusive, for the aggregate sum of Thirty Thousand Dollars ($30,000.00) and is issued for the purpose of defraying the expense of increasing, improving, enlarging, extending, perfecting and adding to the present waterworks system of said City and securing an additional water supply for the purpose of supplying sup-plying and distributing water to the inhabitants thereof, the same to be i owned and controlled by said City and is issued under and pursuant to the Constitution and Laws of the State of Utah and an ordinance passed pass-ed by the City Council of said City, and as authorized by the electors of applied solely for the purpose of the payment of said interest and principal prin-cipal of said bonds, respectively, and for no other purpose whatever, until the indebtedness so contracted under this ordinance, principal and interest, shall have been fully paid, satisfied and discharged; but nothing herein contained shall be so construed as to prevent said City from applying any other funds that may be in the City Treasury and available for that purpose pur-pose to the payment of said interest and principal as the same respectively respective-ly mature, and the levy or levies herein here-in provided for may, thereupon, to that extent be diminished. And the sums herein provided for to meet the interest on said bonds and to discharge dis-charge the principal thereof when due are hereby appropriated for that purpose, pur-pose, and said amount for each year shall also be included in the annual appropriation bills passed by the City Council of said City in each year respectively. res-pectively. All proceeds derived from the sale of said bonds must be applied ap-plied exclusively to the purpose for which said bonds' are issued. Said bonds, and each of them, shall be signed by the Mayor and City Treasurer and attested by the City Recorder and sealed with the corporate cor-porate seal of said City, and the said coupons shall bear the fac-simile signature sig-nature of the City Treasurer. The Mayor and City Treasurer are, each, hereby empowered and directed to sign, the City Recorder to sign, attest at-test and affix the seal of the City to each of said bonds, and the acts of said Mayor, City Treasurer and City Recorder in so doing are, and shall be, the act and deed of said City. All the covenants, statements, representations represen-tations and agreements contained in said bonds and coupons and all recitals re-citals and representations of this ordinance or-dinance are hereby considered and understood, and it is hereby ordained and declared that said covenants and promises therein are the covenants and promises of said City, and that the representations and statements thereon are the representations and statements of said City. Section 3. AND IT IS FURTHER ORDAINED, that all ordinances and resolutions, or parts of ordinances and resolutions, in conflict with the provisions hereof be, and the same are hereby, repealed and after said bonds are issued, this ordinance shall be and remain irrepealable until said bonds and the interest thereon shall have been fully paid, satisfied and discharged as herein provided.
