' In Relation to the Brigham City Water "Works. j See. 1. Be it ordained by the ' City Council of Brigham City: That the water works constructed j bv Brigham City Corporation, to! supply Brigham City with water1 from Devil's Gale Canyon, and i other places, shall be designated j and known as the Brigham City Water Works; they shall be the property of said city, and shall be under the sole and exclusive control con-trol of the City Council, who may ; from time to time direct tlie construction con-struction of such reservoirs, water I tanks, water mains, service pipes : and lire hydrants, as the ncces-j ncces-j sities of the inhabitants of the ; Cit v may require. The City Council shall also appoint a Super-: Super-: intendenl of Water Works, and an Assessor of Water Kates, and such other olficers as may be necessary to carry on the works. All otlieers so appointed shall hold ollicc i during the pleasure of the Council. I Sec. 2. See. 10. 1 f a ny water taker shall permit any person from : other premises, or any unauthorized unauthor-ized person to u.m or obtain water from his premises except for drinking purposes or water fixtures, whether inside or outside of his building, the supply of water may be cut oil' and the amount paid forfeited, and such unauthorized person for taking said water, shall lie liable to a line of not to exceed feu dollars for each oiTense. See. 11. Ul. The Assessor of Watt. ' Bates shall make semi-annual assessments as-sessments for water on the owners of property having made application applica-tion therefor, based upon the rates hereinafter establi-hed, and dated from the lirst day of January ami the first day of Juiy of each year , respectively. Said Assessor shall ; make prompt returns of his doings to the City Beeorder, who shall 1 charge to each person the amount assessed against him, which amount shall be payable on demand, nnd shall be colleeied ami paid into the City Treasury in the same manner as oilier license fees are collected and paid in. See. 22. Tho annual rates for a supply of water from tho water works; to be paid semi-annually in advance are hereby fixed and established as follows, to wit: linker 10.(l0 Butcher shops 10.00 Barber shops, not exceeding two chairs 7.l0 For each additional chair. . . 1.00 vice pipes, and the regulation of tho water supply to fire hydrants and to all water takers. Said water Superintendent, before entering en-tering upon the duties of his ofilce. shall take an oath of olliee and give bonds, with approved security to Brigham City, in the penal sum of $1,000.00 conditioned for tho faithful performance of his duties. He shall report to the City Council quarterly, or oftcner, if required, his doings as Superintendent, Super-intendent, the condition of the water works, and make such suggestions sug-gestions as the nature, of the service ser-vice may require. Sec. 3. All public fire hydrants shall be under the control of, and shall be kept in repair by the Superintendent of Water Works, and in case of lire or fires, the fire department and such others as the Superintendent shall authorize, shall have free access to said hydrants. No other person shall open or operate any five hydrant, or attempt to draw water therefrom. Sec. 4. Any person who shall wilfully or carelessly run a vehicle against a lire hydrant, or otherwise other-wise wilfully or carelessly injure the same, or draw or attempt to draw, water therefrom, or hitch horses or other animals thereto, shall be subject to a fine not exceeding ex-ceeding one hundred dollars, and be liable for all damages done to said hydrant. Sec. 5. Wrenches for firo hydrants hy-drants shall be furnished, by the Superintendent, to the fire department depart-ment for their use, and to such other persons as he may deem proper, and any member or ofiicor of the lire department, or other persons having charge of one or more of said wrenches, who shall permit the same to be taken from their place of deposit, or to be used for any other purposes than those authorized by the Superintendent Superinten-dent shall be liable to a fine in any ; sum not exceeding twenty-five ! (i?25) dollars. ! Sec. lb Jt shall not bo lawful for any person to befoul the waters of any public drinking fountain, or to water horses or other animals thereat, or to tie animals thereto, or to tie to any watering trough i in this city. Any person violating violat-ing any id' the provisions of this section shall be liable to a line in any sum not exceeding twenty-live ($25) dollars. See. 7. Whenever any property owner desires to obtain a supply of wr.ter from tho city water works, ho shall make application therefor, there-for, in writing to the Superintendent, Superinten-dent, and sign an agreement that ! he will be governed by such rules I and regulations, not inconsistent with this Ordinance, as may be I prescribed by tin; Mayor for the1 j control of the water supply; said I application must stafe the location, I kind of building, number of rooms. , j and the entire area of grounds to j be supplied, and fully and truly, j state the purpose for w hich tho water is to bo used. See. 12. If any water taker shall waste water, or allow it to be wasted by negligence, such as imperfect stops or valves, or leaky joints or pipes, or allow tanks to leak or overllow, or wasteful ly run it through basins or other apparatus, or use the water for purposes other than stated in the application and license, or in violation of the rules and regulations for controlling the water supply, and the provisions of this Ordinance, he shall be liable to a fine of not to exceed twenty five dollars for each offense, and the water may bo cut off from such water taker, and all payments forfeited, for-feited, unless such person shall promptly pay such additional charges as may bo imposed. Sec. 13. Whoever, by himself, family, servant, or agents, shall use the water coining through the water mains without first obtaining obtain-ing a license therefor, or shall without with-out authority open any stop-cock, valve, or other fixture attached to the system of water supply, or shall in anywise injure, deface or impair any part, or any appurtenances appurten-ances of tho water works, or shall cast anything into or bathe in any reservoir or tank of said works, shall be punished by fine not exceeding ex-ceeding one hundred dollars for each offense, or by imprisonment not exceeding six months, or by both fine and imprisonment. See. 14. If any person, after the water has been turned off from his premises, on account of non-payment of dues, or violation of tlio rules and regulations pertaining to the water supply, shall turn the water on again, or use, or allow the water to be used without authority, ho shall lie lined not exceeding , fifty dollars for each offense. Sec. 15. Fountains and sprinklers sprink-lers for lawns, gardens, yards or sidewalks, shall not be opened during dur-ing a fire. No fountain attached shall be greater than one half an inch in diameter. There shall be a stop-cock io each fountain attachment, attach-ment, which shall .be under the control of the Superintendent. Sec. 1 G. Sprinklers for lawns, gardens, yards and sidewalks must be used only for the purpose expressed in the license, and no sprinkler shall be used for sprinkling sprink-ling any street or sidewalk unless sue!) privilege is included in the license and paid for accordingly. No no.zle for sprinkling shall be larger than .-inch in diameter, and :' license for sprinkling shall be issued except in connection with other water service. Sec. 17, Sprinkling wagons must be filled from hydrants erected erect-ed for that purpose, and shall be regulated and controlled by the Superintendent. Sec. 1 . For a supply of wafer for u ny purpose not specifically designated, the price shall be fixed by the Assessor As-sessor of Water Rates corresponding correspond-ing with the standard hereinbefore established. See. 23. Any person violating any of the provisions of this Ordinance, Ordi-nance, where the penalty is not herein otherwise provided, shall, on conviction, be liable to a fine of not exceeding fifty dollars for each ! o lien so and in all eases arising 'under any of the provisions of this ; Ordinance the person convicted , may be imprisoned at hard labor! at the .rate of one dollar per day until the fine and cost are satisfied. Sec. 2-1. Nothing herein contained con-tained shall prohibit the City Council from amending. altering, or adding to the provisions of this Ordinance in relation to the water supply or the rules and regulations which may be adopted in conformity conform-ity therewith.
