Show COUNTY ROAD AID IN CITIES LEGAL Power of county commissioners to ' spend county road funds is limited j by arrangements to be made with the j city officials, who must acquiesce at j least in the road improvement, and also by the law saying that county roads within incorporated cities may not be more than three miles extending extend-ing in any one direction. This is the substance of a reply from Harvey II. Cluff, attorney general, to Howard C. Means, state road engineer, through J. R. Ellis, assistant state! road engineer. The question is "is it legal for a county to spend county j road funds within the limits of a city J or incorporated town." J Mr. Cluff refers to former opin-. ion which touched on this subject, and quotes the law covering county roads; within incorporated communities. j "I think there is no questino," he , deduces, "but that the county com-I com-I missioncrs can legally spend county ; road funds Within the limits of a. j city or incorporated town. The only thing necessary would be for them to spend such money under the direction, or with the advice, consent and approval ap-proval of the proper officers of such city or town." |
