Show policy of utah automobile scenic highway interest will continue to operate an automobile touring bureau tor for exploiting the scenic beauties of 0 the state and the routing of 0 automobile traffic to the best interests of 0 the tourist and the state according to announcement made by ellas elias S woodruff secretary of 0 the scenic highway association announcement follows the decision recently made by judge chris mathison of the third district court permitting the scenic highway association to incorporate a separate touring bureau under the name of 0 the auto club ot of utah the utah state automobile association and N D rishel sought to enjoin the scenic highway alsoc assoc association a from using the auto club name in order to secure tor for itself a monopoly on the touring bureau names in the state Ris hels organization filed on a score of 0 trade names which it claimed the right to use with the apparent purpose ot of forestalling incorporation po ration of 0 the auto club ot of utah by mr air woodruff and associates consequently when these papers came before the secretary 0 of state the utah state association vigorously protested the granting of 0 a charter but after a full hearing N E crockett secretary of state denied to allow bill rishel the exclusive right to the use of touring designations and granted the charter to the auto club of 0 utah thereafter injunction proceedings were brought in the district dourt court and in the decision recently handed judge mathison decided in favor of 0 the scenic highway association in its tight fight to build up a touring body which would be representatives ot of the entire state the court denied rishel the exclusive right to the word utah on oil the ground that it was a geographical designation and also denied exclusive rights to use the word auto association as this phrase merely designated the business engaged in the utah state association failed to show that the auto club of 0 utah was attempting to exert any unfair competition and no evidence was brought out to prove that the auto club had practiced any fraud or was attempting to deceive in aay any manner by its incorporation under this name according to the courts decision in fighting tor for use of this name the auto club of utah is seeking merely the privilege of using a designation such as will bo be descriptive of its business said mr air woodruff thereas Th ereis no reason that I 1 have been able to fathom why a competing auto touring body should not be formed where one already organized has failed to function satisfactorily as aa has been the case here the utah state association at attempted to t bhoj that it hall had been using this nama of 0 the auto AULO club of utah tor for years when ts is a matter of tact fact it has tailed failed to use it at all in the last several years admittedly mitt edly there is considerable mall mail addressed to an organization under the auto club name but this is seeking merely touring touring data and was not sent expressly to mr air Ris hels organization or to any other the newly incorporated corp orated auto club will be equipped to supply data requested as will any other the scenic I highway association in building up the auto club of utah will ask support from the people for the club as an independent organization which is being formed to fill a need long left in this state namely a touring unit which will furnish data which will be e to the best interests of the tourists as well as the state as a whole the club will endeavor to show tourists as much as possible during their sojourn here and to this end the club will furnish maps and data as to roads and accommodations which will take into consideration the comfort and welfare of the tourist as well the need for a separate touring organization has become mo more to apparent in the last few years as many sections of the state have felt themselves poorly represented in the then existing organization it was to till fill this need that the scenic highway Hig liway association and the auto club of utah were formed and it is with this in mind that support will b DC e solicited for the two organizations in all sections of utah |
