Show Panguitch City Council Talks About ATV Ordinance; Panguitch Main Street PANGUITCH - Panguitch Mayor Janet Oldham, along with City Manager Allen K. Henrie, City Recorder Cindy B. Johnson, and council members Denny Orton, J. Arthur Cooper, Leland Pollock and John Orton were present at the meeting on Tuesday evening, Oct. 26 of the Panguitch City Council. Randy Hatch was absent. Also present was Attorney Wallace A. Lee. Opening Ceremony The . opening ceremony was conducted by Wallace A. Lee. Adoption of the Agenda A motion was made and passed all in favor to adopt the agenda as outlined. Approval of the Minutes Minutes for Sept. 28 and Oct. 12, 2004 were approved as corrected. cor-rected. The motion passed all in favor. Upcoming Meetings Community Volunteer Dinner ' Nov. 10, 2004 6 p.m. Allen Henrie updated the city council on the impending community com-munity dinner. He reported that they would be serving hamburgers, hamburg-ers, hot dogs, Dutch oven potatoes pota-toes and brownies. Main Street Report Jess Johnson Jess Johnson said she would like to send a letter of thanks to Steve and Janine Fellows for all their past efforts regarding the balloon festival and also a letter to Elaine Sawyer for all of her efforts on the Quilt Walk Festival. The individuals mentioned men-tioned above have spent a lot of volunteer time in regards to the above listed events and the city really appreciates all they have done. Johnson reported on the goals of the Main Street organization. The balloon festival is in the works. There was to be a committee com-mittee meeting Oct. 17 at 6 p.m. Jess stated that she was going to begin business luncheons each month with a different speaker at each meeting. Anyone is invited, the cost of the speaker is free. Anyone choosing to eat lunch will be responsible to pay for their own meal. She reported also that the Main Street meetings held in Richfield were very beneficial. She also reported that she is going to nominate Panguitch for one of the dozen distinctive destinations des-tinations in the nation. Public Hearing ATV Ordinance Mayor Janet Oldham opened the Public Hearing at 7 p.m. There were several citizens in attendance. Panguitch City received the ordinance from several different cities in the state and Allen K. Henrie reported report-ed on the findings of how other communities deal with off-highway vehicles. Mayor Oldham asked those in attendance how they feel about the current ordinance. Cydnee Quitter expressed her concerns regarding ATV usage by kids in the community. Mayor Oldham went over the current Panguitch City ordinance ordi-nance which states a designated route to get out of, town, OHV's are not permitted on any other streets in Panguitch, speed limit 5 mph and OHV's are not allowed before 5 a.m. and after 10 p.m. Allen K. Henrie reported on other ways communities have dealt with the OHV problems. Deputy Danny Perkins stated that he is for the ATV restrictions restric-tions and feels the city should tighten up the ordinance. Perkins would like to make all OHV's have baffles on them. Denny Orton feels that ATV's should be on the road where they are more visible. Michael Johnson stated that his family members are avid moto cross riders and stated there are no after market parts to make two strokes quieter. Jim Johnson stated that these bikes are not more noisy than a Harley Davidson motorcycle. Jerry LeFevre suggested that the city allow OHV's on the road and have them abide by the same rules that vehicles are to adhere to. LeFevre also stated that a ticket or two would really help the problem along with proper signage on roadways. Other suggestions included citing kids who have not had the proper training with the state parks. The city will have a course for OHV riding in the spring. The city will try to have a changed ordinance in place by Jan. 1,2005. Mayor Oldham would like to see a kiosk placed where the county dumpsters currently are. A gentleman from the state of Utah, Eric Stukki, was in attendance. atten-dance. He is over the OHV rules and regulations for the Utah State Parks and reported that their number one priority is the success on training people on OHV's and offer any resources they have to help with this issue. He stated that ATV's are not made for paved roads but felt 15 miles per hour on a paved road would be within reason. Chip Sealing Policy in Commercial District A motion was made and passed all in favor to set a policy poli-cy stating that if a business in any commercial zone is willing to put in sidewalk, curb and gutter, gut-ter, then the city would chip seal the right of way. Five Counties Garfield County Planner A motion was made and passed all in favor to table this item regarding Kurt Hutchings, Garfield County Planner, Five County AOG until the next city council meeting, t Christmas in the Country Donation - $250 . A motion was made and passed all in favor to donate $250 for the Christmas in the (See COMMISSION on pg. 3) Commission From Front Page Country event under the direction direc-tion of Pat Oetting. Sub for Santa Donation - $500 A motion was made and passed all in favor to donate $500 for the Sub for Santa program pro-gram under the direction of Pat Oetting. John Orton stated that the inmates have been making dolls and hats and would like to donate them as well. Social Hall Monitor New Hire A motion was made and passed all in favor to ratify the hiring of John Blevins as the new Social Hall monitor. Water Project The cement has all been poured on the renovation of the existing water tanks. The contractors con-tractors are doing a good job and the project is almost complete. Panguitch Airport The airport is now open. The only thing needing to be done is the paint on the runway. Financial Report Allen K. Henrie Allen Henrie reported on the financial report with the city council. All budgets are in line other than the Triple C. The council asked for a more simplified simpli-fied report the first of November after the city settles with the county regarding the Triple C. According to the records, the council reviewed the concessions conces-sions from 72004 to 102004 only made $448.04. Water Certificates Randy Hatch Randy Hatch was not in attendance. Allen Henrie reported report-ed that he needs to transfer water certificates back to those who are back on the West Panguitch system and off of the cities pressurized pres-surized system. Henrie needs to do some paper work to complete this. Executive Session A motion was made and passed all in favor to move into executive session at 9:10 p.m. to discuss the character and professional profes-sional competence of an individual. individ-ual. A motion to come out of (See COMMISSION on pg. 4 w ii i Commission From Page 3 A executive session passed all in . favor at 10:05 p.m. Multi Purpose Events Center Scott Christensen had some questions on the resort tax and how it can be used. Mayor Oldham explained that the resort tax is used over a number of things such as the ball diamonds, dia-monds, Triple C, Main street and some miscellaneous eventing. Christensen reported on the upcoming events and activities. Paving, curb, gutter and landscape land-scape are all on the to do list down there. Department Reports JP Fine Report A motion was made and passed all in favor to accept the JP Fine Report but no details were forthcoming in the minutes of what that report entailed. Playground Equipment The city has been awarded a $30,000 grant for new playground play-ground equipment. Highway 143 The city was turned down last year on their grant request. We need to resubmit the proposal. The council would like to see Jess Johnson on the Hwy 143 committee if she is willing. Garkane Garkane representatives emailed Allen Henrie regarding who can do appraisals on the current Utah Power system. Dog Problems There have been some major dog problems recently. Newsletter A newsletter is coming out soon. We need to include the ATV ordinance revision. Five County AOG This group has some real concerns con-cerns regarding Initiative 1 and suggested the city not be in favor of it. (See COMMISSION on pg. 3) Commission From Page 4A Rural Development Fund Board This board has awarded the city $48,000 for the chlorination building and fence. UDOT Denny Orton reported that the state is finally going to build a new shop for the UDOT crew here in town. Panguitch City is first in line to purchase the existing exist-ing shed. Current Bills The council reviewed the current cur-rent bills to be paid and a motion was made and passed all in favor to pay those current bills. Adjournment The meeting was adjourned at 10:40 p.m. |
