Show mm amm NOTICE OF PUBLIC HEARING Boulder Town will hold a public hearing on November 19, 1992, at 7:00 p.m. at the Boulder Elementary School to receive comments on the following proposed ordinance: Ordinance No. 22 AN ORDINANCE OF BOULDER BOUL-DER TOWNMMPOSING A 90-DAY 90-DAY MORATORIUM ON NEW LAND DEVELOPMENT, IN ORDER OR-DER TO DEVELOP AND ADOPT A TOWN-WIDE ZONING ORDINANCE ORDI-NANCE THAT WILL REDUCE THE POTENTIAL NEGATIVE IMPACTS ON NON-CONTROLLED GROWTH. THE TOWN BOARD OF BOULDER TOWN DOES ORDAIN OR-DAIN AS FOLLOWS: Section 1. Notwithstanding any provision of law to the contrary, no application for a land use permit for a project shall be accepted for filing and processing, except when the following findings can be made: (1) A land use permit where it can be seen with reasonable certainty that the project will cause no increase in-crease in water consumption over historical water consumption used for lawful purposes of the parcel. (2) ALTERATIONS AND ADDITIONS ADDI-TIONS TO EXISTING BUILDINGS. BUILD-INGS. 1. Nonresidential structure. A land use permit to alter, repair, maintain, convert, or change the use of a lawful nonresidential structure or portion thereof, provided (i) no increase in gross floor area will occur, oc-cur, and (iijno new dwelling units are created. 2. Residenual structure. struc-ture. A land use permit to alter, repair, maintain or enlarge an existing exist-ing residential structure or portion thereof, or to construct an accessory building to an existing residential structure, provided no new dwelling units are created. (3) 25 of the building's foundations have been instal ledpoured prior to December 3, 1992. Section 2. Ordinance No. 22 is consistent with the Municipal Land Use Development and Management Act of the Slate of Utah (Section 10-9-404) in that by local ordinance, ordi-nance, a City or Town may establish estab-lish temporary zoning regulations prohibiting the erection construction, construc-tion, or alteration or any building or structure or subdivision approval, when the legislative body makes a finding of compelling public interest. inter-est. c The establishment of a temporary tempor-ary building moratorium (90 days) and the development of a Boulder Town Zoning Ordinance is of compelling com-pelling public interest in that their establishment will supplement the Boulder Town- General Plan (Master Plan) ensuring that the existing ex-isting rural quality of life may be preserved. Section 3. Any violation or attempted at-tempted violation of this ordinance shall constitute a misdemeanor and may be restrained, corrected, or abated, as the case may be, by injunction in-junction or other appropriate proceedings pro-ceedings pursuant to state law, and issuing a stop work order for any and all work where the violation or attempted violation originated. Section 4. Ordinance No. 22 shall become effective on December Decem-ber 3, 1992 and terminate on March 4, 1993.
