Show BROWN SALOON CASE. (From Box Elder News.) No little interest was manifest in the case of Dr. R. J. Smith, ct. at., vs. A. M. Brown, which was up before be-fore the County Commissioners in the Court House last Saturday. The defendant' Brown is conducting conduct-ing a liquor business at Collinston, and the plaintiffs sought to have his license revoked, charging Brown with conducting a disorderly house, selling liquor to minors and violating violat-ing Sunday closing law. The prosecution pros-ecution was conducted by County Attorney Nels Jenson, and Mr. Brown was represented by Messrs' J. D. and B. C. Call. A good many witnesses for both sides were present, the testimony of whom created considerable am-usemcn am-usemcn for the spectators as well as the court. After the opening of the hearing, Mr. J. D. Call made an argument in support of a motion to dismiss the case, citing a number of authorities author-ities to prove that the Commissioners Commission-ers had no jurisdiction in the matter, mat-ter, and that no charge had been filed. The motion was resisted by the county attorney and after a brief deliberation, the commissioners overruled the motion, and the trial was proceeded with. A number of witnessess for the prosecution tcs-, tificd as to having seen gambling in the saloon as well as to having purchased liquor on Sunday. Some of the witnesses were minors who testified to having bought liquor of Mr. Brown. The defense called their witnesses witness-es to prove the incorrectness of the charges, a large unlber being examined. ex-amined. The case was finally submitted and the commissioners took the matter under advisement until next Monday, their regular meeting date. There seems to be two factions fighting each other. Mr. Brown counter charges Dr. Smith, who conducts a drug store at Collinston, with trying to force him out of business 'in order that the drug store may reap a rich harvest. The towns of Collinston," Beaver Dam, Fielding and Riverside arc very much interested in the outcome of this case. Saturday evening on the way home on the train, Dr. Smith was assaulted by Mr. Brown, who blackened black-ened the doctor's eye and otherwise bruised his face, for which charge have been preferred. |
