Show Dr. Price's Cream Baking Powder World's Fair Highest Award. Bengt Johnson Jr., E. M. Paxman, Thomas Leonard, Kichard Dye, A. Anierberg, Nels Jensen, Chris. Jensen and Lars L. Nelson have joined in a suit against Levi Openshaw, collector of taxes for Utah county to restraii. and enjoin the defendant from selling certain cer-tain lands or any part of them, or in any way collecting city taxes assessed on fiaid lands, alleging that said taxes are illegal because that the said lands on which they are imposed are farming lauds without the platted portion of the city of Provo, beyond the limits of the city proper and receive no benefits bene-fits of the municipal government of the city. An order has been issued is-sued by Judge Smith commanding Collector Openshaw to appear in court on February 3rd to show cause why an injunction "should not be issued restraining re-straining him from selling the lands and premises described in the complaint com-plaint filed by the plaintiffs, or collecting collect-ing the tax therein mentioned and for such other and further relief as may be just. In the meantime the defendant, his agents and servants, are restrained and forbidden temporarily by order of the judge to sell the premises or collect the taxes. The plaintiffs give bonds guaranteeing the payment by them to Mr. Openshaw of any damages h9 may Biistain by reason of the temporary restraining re-straining order of injunction in the action ac-tion if it be finally decided that the same ought not to have been granted, j Kellogg & Corfman are attorneys for plaintiffs. |
