ORDINANCE NO 19993 AN ORDINANCE PROVIDING PROCEDURES FOR THE PURCHASE AND SALE OF PROPERTY AND ORDIREPEALING NANCE NO. 19984 the WHEREAS, Legislature of the Stale of Utah has adopted Section 106122. UCA 1953, as amended, which provides that all purchases of iropcrty by a city shall be made according to procedures established by ordinance or resolution; and the WHEREAS, Legislature of the Stale of Utah has adopted Section 1031219.5, UCA 1953, as amended, which provides, in councilmay-o- r forms of government, that the council shall provide by ordinance for the manner in which property is bought, sold, traded, encumbered or otherwise transferred; and WHEREAS, the City has adopted Ordinance No. 19184 which provides procedures for the purchase and sale of City owned property, and WHEREAS, it is considered necessary and desirable by the City Council of Coalville Gty, State of Utah, to modify Ordinance No. 19984; NOW THEREFORE, be it ordained by the Gty Council of Coalville Gty, follows: Stale of Utah Section 1. Purchases of Personal Property Less Than $10,000. The City Council may dispose of any property belonging to Coalville City and not required for public use. Except as otherwise provided in Section 5, such disposition shall be by public auction or by ' sealed bid at such place in Coalville City as the Council deems City The City appropriate. For the sale of real property for use in a project wherein the principal use is a golf course, arena, stadium, or hall which shall be open to use to the general public, or C. For the sale to a Lessee of real properly which is subject to a lease with an unexpired term (or an option to renew) of more than five (5) years and for which annualized rental is nominal or less than five (5) per cent of the fair market vslue of the properly. D. For sale of vacated roads or streets in those instances where title docs not revert to adjoining but is landowners, retained by the City, or E For the sale of any property of a value of $10,0110 or less. In all instances provid ed for in this Section 5, the' City may dispose of property by sale or exchange for such price andor terms as it shall determine to be just and reasonable and in the public interest, on a case by case basis. In any such instance the Gty may, if it so desires, require that disposition be made by competitive bidding. Section 6. Repeal. This Ordinance supersedes and replaces Ordinance No. 19984 and the latter is hereby repealed. Section 7. Effective Date. This Ordinance shall take effect upon publication.
