In the document, Colorado Attorney General Gale A. Norton, and California Attorney General Daniel E. Lungren submit that the May 8 ruling by the 10th Circuit Court of Appeals runs contrary to the 1994 Supreme Court decision in the Hagen ease. Duchesne and Uintah counties contend the Appeal Court erred in old Supreme finding that the Court ruling did not erase the boundaries of the Ute Reservation. "The derision of this (UJS. Uintah Co. secures $$$ for road bridge repairs It is taking way too long, but Uintah County haa over $3 million in road projects waiting to dear government red tape before they can begin. The county haa secured $2 milium in federal aid to improve the road from about the Merkley Park turnoff to the Dry Fork Settlement road. Construction ahould begin in Oct of 1998. Federal funds will pay 93 percent ofthe prqject leaving 7 percent or about $140,000 for Uintah County to pay. The total prqject ia set at $2.6 million, but will hate to be scaled back because the maximum in federal dollars committed to the project is $2 million. The county haa alao received federal commitment for 80 percent of the coot oftwo bridge replacements. Before high water next spring the county commiaaion hopes to replace the Massey Bridge in Jensen and the Dry Fork Bridge south of the Dry Fork Settlement The two re- - Jlacements are estimated at an additional (100,000 to straighten the road at the Dry Fork Bridge. The widening of 500 North from 1500 West to 2500 West is currently under review. The prqject should be let to bid in December or January and construction could begin in March or April. panel in the 10th Circuit haa directly turned Hagen on its head, causing more uncertainty and confusion than existed prior to that time, the joint brief stated. The Appeals Court ruled that based on the Supreme Court decision in Hagen, the original boundaries of the Ute Reservation remained intact, and that only the n settlers land opened to in 1902 and 1905 waa removed from the reservation. The ruling left about half of Duchesne and weat Uintah counties under the jurisdiction of the Ute Tribe and created "unprecedented jurisdictional chaos within the two counties, the brief stated. Although Colorado and California, aa well as other states have submitted briefs to support the two Utah counties, the State of Utah opted not to file aa a friend of the court, preferring to engage in discussions ofunrelated and related issues. non-India- rt Seeking a Solution Ballard: Annexation wont solve law enforcement needs By - Luka E. Whiting A proposal to allow Roosevelt city to annex a small strip of weat Ballard isn't the answer to the problem created by a lag in response time when a law enforcement officer is needed. Ballard city officials are working with other government entities to find a better solution to ensure officer from the proper jurisdiction are dose at hand when needed. Because Ballard is in west Uintah County it sometimes takes about 30 minutes before a sheriffs deputy from Vernal can respond to a crime scene or call for help in the Ballard ares. Duchesne County School District Superintendent John Aland recently wrote to Ballard city officials to request that Union High and the Uintah Basin Applied Technology Center be placed entirely with the Roosevelt city limits. Because the high school sits squarely on the DuchesneUintah County line, end the technology center is almost entirely in Uintah County its not unusual for confusion to arise over the dual jurisdiction pertaining to law enforcement. The Duchense County School Board proposed the annexation to eliminate the time delays experienced at the schools when law officials are needed from Uintah County, Aland explained. Although there is a Roosevelt city Money Spent At Home Stays At Home. How Much Did Salt Lake Valley GMC Donate To Your Community Last Year? police officer who covers both schools, when hes away, a Uintah County sheriffs Deputy must be called when an incident occurs on the Uintah County side of the high school or technology center. Carey Wold, projects manager for Ballard city, says he believes the problem with the delay in response time may already be solved since meeting with Uintah County Sheriff Rick Hawkins about a month ago. At that time the sheriff committed to stepping-ucoverage on the countys west side, Wold said. In an effort to continue to identify and sort out problems Ballard city officials will soon meet with leaders from Uintah County, Roosevelt city, the Ute Tribe and representatives from the technology center to find a solution that wont involve annexation. 137 S.
