The amendment to the tribe's Law and Order Code went into effect Jan. 24. Edson Gardner, a Uintah County resident who isnt new (o tangling with the tribe over legal issues, has asked a tribal court judge to issue a restraining order to prohibit the resolution bom being enacted. Chief Tribal Court Judge Jr. has scheduled George a hearing on the motion for tomorrow (Wednesday, Feb. S). Gardner is not an enrolied member of the Ute Tribe but does claim in the "Aboriginal membership Uintah Nation." Because legal advocates are often involved in court in between tribal members where it takes a knowledge of customs and culture of the tribe to settle differences, it also makes sense that they should be Native Americans, she stated. to in the capacity of a legal advocate, and alleges that tribal leaders are violating their own constitution, the Indian Civil Rights Act and the federal Equal Protection Act, in prohibiting anyone who isn't a member of a federally recognized tribe from representing a client in Ute Tribal Court "The people should have who ever they want to represent them. If people ask me to represent them my customs and traditions say I have to do this," Gardner stated. "This is totally eliminating all access far my people in tribal court" Unlike State Court where an indigent defendant has an attorney appointed by the court and paid for by taxpayers, Ute Tribe Court offers no such amenities.
