Weve had it to operate with since July 1st and I might also say that the fund definitely does not cover very much. It was a thousand dollars." There were more rumblings from the audience at that, and the question was never answered to the satisfaction of most of the opponents. TO DRAFT HIS DAUGHTERS One of the male opponents to ERA, Mr. Ed Lore, pointed out that The Women supporting ERA today are not going to be drafted but it will affect our young daughters. These benevolent people are not going to get caught that draft but 1 have daughters that are." He indicated that a poll which was run through their office showed that 85 of 81 questioned signed the petition against ERA. feel our legislators He said, should think seriously what the people of the state of Utah really want, especially the women." Tom Quinn, an attorney and State Chiarman of Utah Common Cause which promotes ERA said the protective legislation number of hours a the to relating woman may work, the number of pounds she may lift on a job, and the kind of work she may perform, were passed in an earlier era when such legislation was deemed necessary." Now, he says, these laws serve primarily to restrict the in 1 NOT SAYS ENOl-G- POLICEMEN One of the proponents, Virginia Cutler, introduced herself as a Saint mother," devout Latter-da- y President of the Association of University Women, and a member of the Governors Committee on the Status of Women. She said the Equal Rights Amendment isn't anything new for us. We already have this. Actually, it hasn't been enforced." She cited Article 4 Section I of the Utah Constitution which reads: The rights ofcitizens of the State of Utah to vote and hold office shall not he denied or abridged on account of sex. Both male and female citizens of this State shall enjoy equally all civil, political and religious rights and privileges." Mrs. Cutler went on to say that this has not been enforced. We would never have a budget large enough to provide all of the policemen to see to it that this law is upheld." she said. Dr. Allyson Thorne, a mother of live and teacher, speaking in favor of the ERA indicated: This does not mean that women who have small babies are going to be drafted. It is not true that the is family going to crumble so-call- ed employment opportunities of women by keeping them out of some jobs w hich offer them higher pay and advancement. FORMER DEAN, PENNSYLVANIA LAW SHCOOL Jefferson B. Fordham, formerly Dean of Law at the University of and presently Pennsylvania Professor of Law at the University of Utah spoke in favor of ERA. However, he did say the court may not interpret it in a way we would want. It is true," he said, "and 1 grant this reality as a proponent and supporter of this proposal, that we cant anticipate just how it will be interpreted by the final authority of the land (referring to the Supreme Court). It may be that some of the interpretations of the instantaneouslv because we have this. HOTDOG COMMITTEE of the sort that you Court and I wouldn't want. But in the totality, over time, I think we can rely upon our basic institutions like the Supreme Court to serve us well." Professor Fordham further said: Much has been made of the point that women might be drafted. It may be that the court would interpret this to enable Congress to subject women to the draft. POLL CITED Rayanna Christiansen cited a telephone poll taken by Melvin L. will be Wilkinson which asked such questions as: Are you in favor of the part of the amendment which makes women subject to the draft the same as men?" She said that 79 said NO," 17 said YES, and 4 were undecided. She said another question on the poll was: Are you in favor of the ERA as it now exists becoming part of the Constitution? She said 70 answered No, 11 answered Yes," and 19 were undecided. This, she said, indicates that Utah County is overwhelmingly against the Equal Rights Amendment in its present form. CITES YALE LAW JOURNAL would have to permit her to do so if it would permit a man in a similar situation to keep the name he had before marriage or changed to a new name. Mrs. Johnson further quoted parts of the Journal which states that married women would, have the same independent right of Thus, common law and domicile" (home) as married men now have. She pointed out that a husband, then, could not sue for divorce on the ground of desertion if the wife refused to live in his home. The domicile law would extend equally to married women as it is now extended to married men. statutory rules requiring a name change for a married woman would become legal nullities. A man and woman would still be free to adopt the same name and most couples would probably do so for reasons of identification, social custom, personal preference, or consistency in naming children. However, hte legal barriers would have been removed for a woman to use a name that was not her husbands." In a state where both spouses were required to have the same last name the children would simply take their parents' name. If the state had no requirement that the husband and wife have the same name they could either require the parents to choose one of their names for their children or it could decide to have no rule at all. The amendment will only prohibit the states from requiring that the child's last name be the same as his or her fathers or from requiring that the childs last name be the Opposed To Girls Our (HOTDOG) Degrading Committee, said they have inlisted over 300 members in a very short time. She has worked 44 years of her life and said she knows what it means to he discriminated against in wages. I o correct some of these inequities Mrs. Laenby indicated that Representative Georgia the ERA, Adeline Johnson quoted extensively form the Yale Law Journal, the first part related to name change. She said: In the past, and up to the present, it is the privilege of the woman to take the name of her w onderful man whom she chose to marry because she loved him. The Equal Rights Amendment will not permit a legal requirement or even a legal presumption that a woman takes her husband's name at the time of marriage. In a case where a married woman wished ttf retain or regain her maiden name or take some new name a court Mrs. l.azenby reports her committee has 11.200 signatures against ERA and they are still eoming in. She said that Senator Rees, who represents six counties, has received 1.258 letters against ERA and only 2 f or it. In summation. Mrs. I.aenby said. I havent found out it can give us anything we don't yet have, or can't have, through proper legislation in our ow n state." AMENDMENT the HOTDAG Committee, warned, 1 would like to make the point here today that there have been no guarantees given us as to what this bill will do or what it will not do. Mrs. Boucher quoted the last part of the Utah State Constitution again as she said: Our state Constitution has been quoted. I would like to quote the last part of it again for you. It guarantees both males and females religious, civil, and political rights. I see no such guarantees in this bill as it is written;;.
